Last week, by a 5-to-4 vote, it said state programs that provide scholarships to students in private schools <a href=\"https:\/\/www.nytimes.com\/2020\/06\/30\/us\/supreme-court-religious-schools-aid.html\" title=\"\">may not exclude religious schools<\/a>.<\/p>\n<p>The three decisions were part of a broad examination of the relationship between church and state over the 15-year tenure of Chief Justice John G. Roberts Jr. in which the court\u2019s conservative majority has almost always sided with religious groups.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p>Many religious groups praised the contraception decision. \u201cThe government has no business forcing pro-life and religious organizations to provide drugs and devices that can destroy life,\u201d John Bursch, a lawyer with Alliance Defending Freedom, said in a statement.<\/p>\n<p>Organizations seeking to protect access to birth control and abortion denounced the ruling as an assault on women that, as NARAL Pro-Choice America <a href=\"https:\/\/twitter.com\/NARAL\/status\/1280885347669258240?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1280885347669258240%7Ctwgr%5E&#038;ref_url=https%3A%2F%2Fwww.commondreams.org%2Fnews%2F2020%2F07%2F08%2Fsupreme-court-ruling-denounced-dangerous-and-serious-attack-womens-right\" rel=\"noopener noreferrer\" target=\"_blank\" title=\"\">said on Twitter<\/a>, \u201cgave the Trump administration a green light to attack our birth control coverage.\u201d<\/p>\n<p>The clash between contraceptive coverage and claims of conscience is a key battleground in the culture wars, and the Supreme Court\u2019s decision is likely to mobilize voters on both sides of the divide.<\/p>\n<p>For opponents of the regulation, the decision to uphold it was especially disappointing because two members of the court\u2019s liberal wing, Justices Elena Kagan and Stephen G. Breyer, voted with the majority.<\/p>\n<p>Both justices had been in dissent in 2014, when <a href=\"https:\/\/www.nytimes.com\/2014\/07\/01\/us\/hobby-lobby-case-supreme-court-contraception.html\" title=\"\">the court ruled<\/a> in a 5-to-4 decision that requiring family-owned corporations to provide contraceptive coverage violated a federal law protecting religious freedom.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p>On Wednesday, in a concurring opinion written by Justice Kagan, they said that the Affordable Care Act itself authorized regulators to create exemptions for employers with religious objections, noting that the Obama administration had adopted one limited to houses of worship. Whether the Trump administration had provided adequate justifications for its much broader exemption, Justice Kagan wrote, was a question for another day.<\/p>\n<p>\u201cEven in an area of broad statutory authority \u2014 maybe especially there \u2014 agencies must rationally account for their judgments,\u201d she wrote. The court returned the case to the appeals court for consideration of other challenges to the regulation.<\/p>\n<p>Justice Clarence Thomas, writing for the five more conservative members of the court, agreed that the Affordable Care Act had authorized regulators \u201cto provide exemptions from the regulatory contraceptive requirements for employers with religious and conscientious objections.\u201d But, unlike Justice Kagan, he did not suggest that the regulation remained vulnerable to a new legal challenge.<\/p>\n<p>In dissent, Justice Ruth Bader Ginsburg, joined by Justice Sonia Sotomayor, said the majority had given religious belief too much power.<\/p>\n<p>\u201cIn accommodating claims of religious freedom, this court has taken a balanced approach, one that does not allow the religious beliefs of some to overwhelm the rights and interests of others who do not share those beliefs,\u201d she wrote. \u201cToday, for the first time, the court casts totally aside countervailing rights and interests in its zeal to secure religious rights to the <em>n<\/em>th degree.\u201d<\/p>\n<p>Justice Ginsburg added that the ruling would have vast practical consequences, forcing poorer women to forgo contraception or use less effective methods.<\/p>\n<p>The Obama and Trump administrations have taken very different approaches to contraceptive coverage.<\/p>\n<p>In March 2010, President Barack Obama <a href=\"https:\/\/www.nytimes.com\/2010\/03\/24\/health\/policy\/24health.html\" title=\"\">signed the Affordable Care Act<\/a>, which includes a section that requires coverage of preventive health services and screenings for women. The next year, the Obama administration required employers and insurers to provide women with coverage at no cost for all methods of contraception approved by the Food and Drug Administration. The regulations exempted houses of worship \u2014 including churches, temples and mosques \u2014 from the contraception requirement. But nonprofit groups like schools and hospitals affiliated with religious organizations were covered.<\/p>\n<\/div>\n<\/div>\n<div>\n<p>Some of those groups objected to providing coverage for any of the approved forms of contraception. The regulations it has promulgated made good on a campaign pledge by President Trump, who has said that employers should not be \u201cbullied by the federal government because of their religious beliefs.\u201d<\/p>\n<p>Justice Thomas wrote that the Trump administration was entitled to adopt exemptions, as the health care statute provided regulators with \u201cvirtually unbridled discretion to decide what counts as preventive care and screenings.\u201d It followed, he wrote, that regulators also had discretion \u201cin other areas, including the ability to identify and create exemptions.\u201d<\/p>\n<p>\u201cThe plain language of the statute clearly allows\u201d regulators, Justice Thomas wrote, \u201cto create the preventive care standards as well as the religious and moral exemptions.\u201d<\/p>\n<p>In a concurring opinion, Justice Samuel A. Alito Jr., joined by Justice Neil M. Gorsuch, wrote that \u201cthe A.C.A.\u2019s very incomplete coverage speaks volumes\u201d about the absence of a compelling need to provide it.<\/p>\n<p>\u201cThe A.C.A. does not provide contraceptive coverage for women who do not work outside the home,\u201d he wrote. \u201cIf Congress thought that there was a compelling need to make free contraceptives available for all women, why did it make no provision for women who do not receive a paycheck? Some of these women may have a greater need for free contraceptives than do women in the work force.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p>\u201cA woman who does not have the benefit of contraceptive coverage under her employer\u2019s plan is not the victim of a burden imposed by the rule or her employer,\u201d Justice Alito wrote. \u201cShe is simply not the beneficiary of something that federal law does not provide.\u201d<\/p>\n<p>In dissent, Justice Ginsburg said the majority\u2019s ruling left women \u201cto fend for themselves, to seek contraceptive coverage from sources other than their employer\u2019s insurer, and, absent another available source of funding, to pay for contraceptive services out of their own pockets.\u201d<\/p>\n<p>\u201cReady access to contraceptives and other preventive measures for which Congress set the stage,\u201d she wrote, \u201cboth safeguards women\u2019s health and enables women to chart their own life\u2019s course.\u201d<\/p>\n<p>The states of Pennsylvania and New Jersey challenged the Trump administration\u2019s regulations, saying they would have to shoulder much of the cost of providing contraceptives to women who lost coverage under the Trump administration\u2019s rules.<\/p>\n<p>Last year, a unanimous three-judge panel of the United States Court of Appeals for the Third Circuit, in Philadelphia, <a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/173752p.pdf\" rel=\"noopener noreferrer\" target=\"_blank\" title=\"\">blocked the regulations<\/a>, issuing a nationwide preliminary injunction. Making exceptions to the requirement that employers provide women with coverage of contraception at no cost would have a large practical effect, <a href=\"https:\/\/www.fjc.gov\/history\/judges\/shwartz-patty\" rel=\"noopener noreferrer\" target=\"_blank\" title=\"\">Judge Patty Shwartz<\/a> wrote for the panel.<\/p>\n<p>That, in turn, she wrote, would disproportionately affect access to contraception for poor women. \u201cCost is a significant barrier to contraceptive use and access,\u201d Judge Shwartz wrote. \u201cThe most effective forms of contraceptives are the most expensive. After the A.C.A. removed cost barriers, women switched to the more effective and expensive methods of contraception.\u201d<\/p>\n<p>Among the groups that objected to providing contraceptive coverage was an order of nuns, the Little Sisters of the Poor.
