Fox News senior judicial analyst Judge Andrew Napolitano told “The Daily Briefing<\/a>” Wednesday that the declassified\u00a0list of Obama administration officials who requested the unmasking of\u00a0 Michael Flynn<\/a> had “opened up a can of worms.”<\/p>\n

Acting Director of National Intelligence Ric Grenell declassified the documents earlier this week, and they were released Wednesday afternoon by\u00a0Sens. Ron Johnson, R-Wis., and Chuck\u00a0Grassley, R-Iowa. Prominent\u00a0names on the list<\/a> include then-Vice President Joe Biden, then-Chief of Staff Denis McDonough, then-Treasury Secretary Jacob “Jack” Lew and former FBI Director Jim Comey.<\/p>\n

Napolitano told host Dana Perino\u00a0that some of the names in the documents, such as\u00a0John Phillips<\/a>, President Barack Obama’s ambassador to Italy & San Marino, did not appear to have an obvious\u00a0connection to Flynn.<\/p>\n

“Some of it sticks out, it\u2019s a\u00a0little odd” said Napolitano, who added that he could understand why then-U.S. Ambassador to Turkey John Bass would be interested in Flynn’s communications, since his consulting firm had been paid by a group with ties to Turkey’s government.<\/p>\n

“But the\u00a0unmasking, of course, was about\u00a0materials that didn\u2019t directly\u00a0involve Turkey,” Napolitano added. “This is a can of worms that is\u00a0going to ask more questions than it\u2019s going to answer.”<\/p>\n

Napolitano told Perino tht while Grenell himself did not release the list to the public, he allowed Johnson and Grassley to have access to it with a high likelihood that it would be made public.<\/p>\n

“The question was, [for] what reason\u00a0was it delivered to the senators\u00a0and for what reason was that\u00a0released, because this\u00a0information is supposed to be\u00a0kept secret unless there is a ‘compelling national security\u00a0reason,'” Napolitano said. “That’s from the statute as a basis for releasing.”<\/p>\n

Napolitano also said that the release of the list of names raises questions about who leaked Flynn’s name\u00a0to The Washington Post, which reported extensively in early 2017 on Flynn’s conversations with then-Russian ambassador to the U.S. Sergey Kislyak.<\/p>\n

“There would be a serious problem\u00a0for the person who did that,” he said, “but\u00a0I don\u2019t think that this in any\u00a0way implicates the legal issues\u00a0for the court [in the Flynn case].”<\/p>\n<\/div>\n
