Voters in Minnesota, Virginia, South Dakota and Wyoming on Friday began casting their ballots for the November elections as the early voting periods began in those states.

Starting Friday up until Nov. 2, voters in Virginia can submit ballots in-person at precincts across the state and may send in ballots by mail up until Oct. 23. Those who have requested absentee ballots in Minnesota, South Dakota and Wyoming may now cast their ballots in-person or by mail up until the day before Election Day.

Other states, including New Jersey, Michigan, Vermont and Illinois, are set to begin early voting in the coming week, with 29 other states and the District of Columbia following suit throughout October.

Early voting comes as lawmakers and others have raised concerns about the safety of in-person voting during the coronavirus pandemic. In response, several states have expanded absentee voting, with South Carolina voting Tuesday to allow all voters to cast absentee ballots in November’s elections.

Trump has continued to criticize mail-in voting, claiming without evidence that the practice leads to large-scale fraud.

“What they’re doing is using COVID to steal an election,” the president said last month. “They’re using COVID to defraud the American people, all of our people, of a fair and free election. We can’t do that.”

Voting is a democratic right that gives each citizen the opportunity to influence how future governments address issues important to their community, including aspects of healthcare. But does casting one’s ballot offer any benefits to health? We take a look at some research that suggests that voting may help boost mental health.

In a previous Special Feature, we looked at the intricate ways in which a person’s political participation is tied to their state of health.

Studies have shown that individuals with poor self-reported physical and mental health are less likely to cast their votes in elections than those who experience good health.

Although it remains unclear why this is the case, some researchers have hypothesized that a vicious cycle might be at play. Poor health may reduce motivation, as well as render individuals more socially isolated, which may further decrease their civic engagement.

In turn, the lack of political participation among individuals who report poor health may mean that they do not get a chance to steer healthcare policies and resources in the direction that might help them access a wider range of benefits.

If you would like to check your registration status or register to vote, we have added some useful links at the bottom of this article.

Breaking the cycle of a lack of civic engagement can have a positive impact in more ways than one.

Besides allowing people to weigh in on processes and policies that are bound to affect the society they live in, studies have suggested that the act of voting, in itself, can bring some benefits to mental health and well-being.

In this Special Feature, we look at what some of those benefits are.

In 2001, Lynn Sanders, an associate professor in the Department of Politics at the University of Virginia in Charlottesville, presented the findings of a study on political participation and its psychological benefits at the Annual Meeting of the American Political Science Association in San Francisco, CA.

Her research revolved around a cohort of female participants involved in The National Longitudinal Survey (NLS) of Young Women. According to the study paper, these participants “were age 14–24 [years] at their initial interview in 1968, [and they had] been interviewed 20 times between 1968 and 1999.”

Sanders wanted to find out whether or not voting and active participation in political issues might have any effect on psychological distress.

She found that participation appeared to “[alleviate] psychological distress, which might offset some of the negative mental health consequences associated with disadvantaged social status.”

The participants who seemed to benefit the most from political participation were those who were more “prone to psychological distress.”

As for why this may be the case, Sanders speculated that being politically active may offer individuals a sense of empowerment: They did their best to take their “fate” into their own hands, so to speak.

“Perhaps the most powerful and politically important conclusion emerging from the research I report here is that political activity stands to be a resource that might offset some of the negative mental health consequences associated with disadvantaged social status,” she notes in her paper.

“Part of the disadvantage faced by historically oppressed groups is higher exposure to unfair treatment, including discrimination due to race and gender. Increasingly, our attention has turned to other forms of unfair treatment, including age- and disability-based discrimination. Disadvantaged social status is significantly correlated with mental health.”

“Evidence from the NLS surveys suggests that fighting back helps make discrimination less psychologically consequential. The compelling evidence reported here of more pronounced benefits of political participation among the psychologically vulnerable supports claims from empowerment theorists that political involvements are especially important for historically disenfranchised citizens.”

– Lynn Sanders

Another study — by Prof. Malte Klar, from the University of Göttingen in Germany, and Prof. Tim Kasser, from Knox College in Galesburg, IL — suggested that there may be a link between political activism and various measures of happiness. The researchers published their findings in Political Psychology in 2009.

Profs. Klar and Kasser analyzed the data provided by two surveys and an additional study. The two surveys addressed 341 college students, and the additional study addressed 718 activists.

Based on these data, the researchers conclude that political activism is associated with different forms of subjective happiness and with social well-being.

“The results of [the first two surveys] […] suggest that activists are more likely to experience the satisfaction of basic psychological needs, an indicator of more frequent experiences of intrinsic motivation,” the researchers write in their study paper.

They “also showed that significantly larger percentages of activists met preexisting criteria for ‘human flourishing’ than did those less engaged in activism,” Profs. Klar and Kasser add.

In a final study, the investigators worked with 296 college students. They quizzed the students on their state of well-being after they had either “engaged in a brief activist behavior, a brief nonactivist behavior, or no behavior.”

Overall, in terms of subjective well-being, there was little difference between the three groups. However, Profs. Klar and Kasser noticed that the students who had engaged in an activist behavior reported “significantly higher levels of subjective vitality” than their peers who had engaged in a nonactivist behavior.

“[T]he results of Study 3 provided some data suggesting that the causal arrow may (also) flow from activism toward well-being,” the researchers write.

Some research has also suggested that people who frequently experience racism and discrimination may become more resilient when faced with these stressors if they engage in political activism.

In a 2018 study paper published in Cultural Diversity and Ethnic Minority Psychology, researchers from North Carolina State University in Raleigh, the University of Chicago in Illinois, and the University of Michigan in Ann Arbor discuss the effects of activism on Black and Latinx college students attending predominately white institutions.

For their study, the researchers analyzed data collected through the Minority College Cohort Study. In the cohort they assessed, which had a total of 504 participants, 44% of the participants were Black and the rest were Latinx.

The researchers explain that people who experience racial or ethnic discrimination may often experience more stress, heightened anxiety, and symptoms of depression.

However, through their study, they found that the Black and Latinx college students appeared to be more resilient to such stressors if they were politically active.

“Black students who were more politically active during freshman year reported less stress at the end of freshman year,” the researchers found. This was not true for the politically active Latinx students.

However, for politically active Latinx students, “[race- or ethnicity-related] microaggressions were related to less stress and less depressive symptoms.”

Although not everyone may experience positive mental health effects in relation to civic engagement, having a sense of social conscientiousness can help people take more control of their own lives and help bring communities closer together.

In the words of iconic American poet Maya Angelou: “If you don’t like something, change it. If you can’t change it, change your attitude.”

Mail-in voting across the country has led to a series of anomalous results in recent weeks – including delayed, misplaced and missing ballots, a review by Fox News has found.

As the issues surfaced, Fox News obtained a copy of a recent U.S. Postal Service (USPS) memo sent to employees detailing budget-related cutbacks. Mark Dimondstein, the president of the America Postal Workers Union, told Fox News that the changes are significantly slowing down mail delivery, and that he is concerned about the impact it will have on mail-in ballots in November.

“Anytime the mail slows down, it’s harder for the postal workers to serve the customers, whether it’s a mail ballot or anything else,” Dimondstein said. “So, again, we’re just absolutely opposed to any effort to slow down mail, to delay mail. And that includes, obviously, for the ballots as well.”

In the memo, the USPS says mail carriers may have to leave mail behind at distribution centers in order to make it on time to their delivery routes.

“One aspect of these changes that may be difficult for employees is that – temporarily – we may see mail left behind or mail on the workroom floor or docks (in P&DCs), which is not typical,” the memo reads.

The memo continues: “We will address root causes of these delays and adjust the very next day. Any mail left behind must be properly reported, and employees should ensure this action is taken with integrity and accuracy. This is a critical time for us, when decisive, quick and meaningful action is needed.”

USPS assured Fox News in a statement that mail-in ballots wouldn’t be compromised: “The Postal Service is committed to delivering election mail in a timely manner … the Postal Service’s financial condition is not going to impact our ability to process and deliver election and political mail,” the statement read.

However, USPS has experienced rising delays during the coronavirus pandemic, and numerous sources tell Fox News that the Chicago USPS international processing center suffers from mailing delays of several months. A test package sent by Fox News that was routed through the Chicago processing center has been held up for five weeks and counting. In a statement, the USPS inspector general said more information may be forthcoming in September; the USPS itself offered no explanation.

Republicans have cautioned that the risks are clear. Last week, the GOP notched a major win in a Florida election integrity dispute, and the party says its well-funded efforts are ongoing.

GOP DEFEATS TAXPAYER-FUNDED MAIL-IN BALLOTS IN FLORIDA

“States that abruptly transitioned to a vote-by-mail system saw elections plagued by fraud and infrastructure and logistical nightmares, which should be a clear and ominous warning ahead of November,” RNC national press secretary Mandi Merritt told Fox News. “Democrats’ plot to rapidly implement nationwide vote by mail is a recipe for disaster, disenfranchisement and massive dysfunction in our elections.”

Democrats counter that security concerns are overblown and that enhanced ballot access is a worthy tradeoff in any event. “Election officials spend a great deal of our time building in security measures,” Washington Secretary of State Kim Wyman, a Republican, told NPR last month. “The idea that people could print millions of ballots either within the country or external to the country, just on its face, is not going to pass muster with an election official.”

The following is a state-by-state rundown of major isues that have been detected with mail-in balloting this year alone.

New Jersey: ‘Massive computer issues, genuine scandal’

The New Jersey Globe reported in June that “massive computer issues and U.S. Postal Service delays” meant that thousands of residents wouldn’t receive their ballots until after the state’s July 7 primary.

The paper found that the Statewide Voter Registration System (SVRS) was “crashing several times a day for the last few days, leaving local election officials without the ability to process thousands of vote-by-mail ballots just 11 days before the New Jersey primary election.”

The series of problems led Division of Elections director Bob Giles to tell election officials to “stop processing ballot requests because of network overloads,” according to the Globe.

USPS TRUCK CATCHES FIRE IN NEW JERSEY CARRYING POSSIBLE MAIL-IN BALLOTS

And, in May, experts said a “genuine absentee ballot fraud scandal” was underway following the May 12 New Jersey city council election. Thousands of ballots were disqualified because signatures on the ballots didn’t match with those on file – and, perhaps more concerning, records showed that several thousand mail-in ballots were received but not counted.

“Videos are surfacing online of a single voter carrying numerous ballots,” read one NBC report. “Postal workers were seen leaving some ballots sitting out in building lobbies.”

The NBC report noted that Ramona Javier complained that she was recorded as voting, when in fact she had not.

“We did not receive vote-by-mail ballots and thus we did not vote,” she told NBC, which then showed her an official list of people who had voted on her block – a list that contained her name.

“This is corruption. This is fraud,” Javier said, adding that “there are eight relatives and immediate neighbors she knows of listed as having voted – but who insist they never even received ballots, including one relative who she says has been in Florida for weeks.”

Election law experts sounded the alarm, and Paterson Mayor Andre Sayegh warned that so-called “ballot stuffing” may have occurred.

“This is corruption. This is fraud.”

— Ramona Javier, who voted whether she wanted to or not

“There is a genuine absentee ballot fraud scandal going on in Paterson,” election law expert and University of California-Irvine School of Law professor Rick Hasen said. Hasen wrote: “When someone tries an absentee ballot scheme like this clumsy attempt in Paterson, it is hard to hide. People get caught.”

RealClearInvestigation’s Mark Hemingway reported in June that “following accusations of widespread fraud, voter intimidation and ballot theft in the May 12 municipal elections in Paterson, N.J., state Attorney General Gurbir S. Grewal announced Thursday he is charging four men with voter fraud – including the vice president of the City Council and a candidate for that body.”

More than 3,190 votes, constituting 19 percent of the total ballots cast, were “disqualified by the board of elections,” Hemingway noted.

West Virginia: Postman admits altering ballots

Earlier this month, the Justice Department announced that Thomas Cooper, a mail carrier in Pendleton County, admitted to election fraud.

Cooper “held a U.S. Postal Service contract to deliver mail in Pendleton County,” the DOJ said. “In April 2020, the clerk of Pendleton County received ‘2020 Primary Election COVID-19 Mail-In Absentee Request’ forms from eight voters on which the voter’s party-ballot request appeared to have been altered.”

After the clerk reported the finding to the West Virginia secretary of state’s office, an investigation “found five ballot requests that had been altered from ‘Democrat’ to ‘Republican,'” the DOJ said. “On three other requests, the party wasn’t changed, but the request had been altered.”

Recent research from Stanford University indicates that mail-in balloting may have neutral partisan effect, and that overall vote shares wouldn’t be significantly different.

“Our paper has a clear takeaway: Claims that vote-by-mail fundamentally advantages one party over the other appear overblown,” researchers said. However, deliberate fraud in key districts could alter their conclusions.

California: 100K ballots rejected

More than 100,000 mail-in ballots were rejected by California election officials during the March presidential primary, according to data obtained by The Associated Press in July, highlighting a glaring gap in the state’s effort to ensure every vote is counted.

The California secretary of state’s election data showed 102,428 mail-in ballots were disqualified in the state’s 58 counties, about 1.5 percent of the nearly 7 million mail-in ballots returned. That percentage is the highest in a primary since 2014, and the overall number is the highest in a statewide election since 2010.

Two years ago, the national average of rejected mail ballots in the general election was about 1.4 percent and in the 2016 presidential election year it was 1 percent, according to a U.S. Election Assistance Commission study.

The most common problem, by far, in California was missing the deadline for the ballot to be mailed and arrive. To count in the election, ballots must be postmarked on or before Election Day and received within three days afterward. Statewide, 70,330 ballots missed those marks.

An additional 27,525 either didn’t have a signature, or the signature didn’t match the one on record for the voter.

Kim Alexander, president of the nonpartisan California Voter Foundation that seeks to improve elections, called the uncounted figure discouraging.

“The only thing worse than people not voting is people attempting to vote and having their ballot uncounted,” she said. The tally of nullified votes “can make a difference in a close contest.”

The data didn’t break down the uncounted ballots by party registration. While the overall number was large in March, if it’s the same in November it’s unlikely to affect the presidential race – Trump lost to Democrat Hillary Clinton in 2016 by 4.3 million votes.

But there are expected to be at least several tightly contested U.S. House races where relatively few votes could tip the balance. In 2018, Democrat TJ Cox upset Republican David Valadao by less than 1,000 votes in a Central Valley district. They have a rematch in November.

New York: ‘Scattered problems’

The New York Times reported in June that systemic issues forced many voters to show up at polling places because they simply never received mail-in ballots.

“With many people reluctant to vote in person, or unable to because they have relocated, roughly 765,000 absentee ballots were distributed in the city, according to data released by the New York City Board of Elections,” the paper reported. “Yet many people interviewed at polling stations said they were forced to vote in person because they never received absentee ballots that they had requested.”

Indeed, the “overwhelming majority of calls received through the state attorney general’s voting hotline leading up to Tuesday’s primary were from voters who applied for an absentee ballot but had not received it,” the paper observed. “More than three weeks after the New York primaries, election officials have not yet counted an untold number of mail-in absentee ballots, leaving numerous closely watched races unresolved, including two key Democratic congressional contests. The absentee ballot count — greatly inflated this year after the state expanded the vote-by-mail option because of the coronavirus pandemic — has been painstakingly slow, and hard to track, with no running account of the vote totals available.”

The president’s view

In May, Twitter slapped a warning label on one of President Trump’s tweets for the first time, cautioning readers that despite the president’s claims, “fact-checkers” say there is “no evidence” that expanded, nationwide mail-in voting would increase fraud risks – and that “experts say mail-in ballots are very rarely linked to voter fraud.”

Twitter’s new warning label was issued even though a Twitter spokesperson acknowledged to Fox News that Trump’s tweet had not broken any of the platform’s rules, and even though several experts have called mail-in balloting an invitation to widespread fraud.

“Absentee ballots remain the largest source of potential voter fraud,” read the conclusion of a bipartisan 2005 report authored by the Commission on Federal Election Reform, which was chaired by former President Jimmy Carter and former Secretary of State James Baker.

“Twitter ‘fact-checkers’ really suck,” wrote Dan Bongino, a Fox News contributor. He linked to a 2012 article in The New York Times headlined, “Error and Fraud at Issue as Absentee Voting Rises.” The article states that “votes cast by mail are less likely to be counted, more likely to be compromised and more likely to be contested than those cast in a voting booth, statistics show.”

Separately, GOP chairwoman Ronna McDaniel observed that Alabama’s secretary of state, John Merrill, told CNN earlier in the day that five of the six voter fraud convictions during his tenure related to absentee balloting.

Fox News has reported that Twitter’s “Head of Site Integrity” Yoel Roth is in charge of fact-checking efforts – and that he has previously referred to Trump and his team as “ACTUAL NAZIS,” mocked Trump supporters by saying that “we fly over those states that voted for a racist tangerine for a reason,” and called Senate Majority Leader Mitch McConnell, R-Ky., a “personality-free bag of farts.”

Fox News’ Hillary Vaughn and Alex Nerska and The Associated Press contributed to this report.

Republicans and Democrats seldom agree on much in 21st century politics — but one issue that divides them more than ever may be voting and elections.

The parties didn’t only battle about whether or how to enact new legislation following the Russian interference in the 2016 election. They differ in the basic ways they perceive and frame myriad aspects of practicing democracy.

Primary Election Snafus Show Challenges For November Vote

Republicans’ and Democrats’ vastly different starting points help explain why the politics over voting and elections have been and likely will remain so fraught, through and beyond Election Day this year.

Sometimes it sounds like the politicians involved barely live in the same country. It has become common for one side to discount the legitimacy of a victory by the other.

The coronavirus pandemic, which has scrambled nearly everything about life in the United States, makes understanding it all even more complicated. Here’s what you need to know to decode this year’s voting controversies.

The Rosetta stone

The key that unlocks so much of the partisan debate about voting is one word: turnout.

An old truism holds that, all other things held equal, a smaller pool of voters tends to be better for Republicans and the larger the pool gets, the better for Democrats.

This isn’t mathematically ironclad, as politicians learn and re-learn regularly. But this assumption is the foundation upon which much else is built.

New Poll: Americans Overwhelmingly Support Voting By Mail Amid Pandemic

Traditionally, Republicans tended to support higher barriers to voting and often focus on voter identification and security to protect against fraud. All the same, about half of GOP voters back expanding vote by mail in light of the pandemic.

Democrats tend to support lowering barriers and focus on making access for voters easier, with a view to encouraging engagement. They support expanding votes via mail too.

The next fight, in many cases, is about who and how many get what access via mail.

All this also creates a dynamic in which many political practitioners can’t envision a neutral compromise, because no matter what philosophy a state adopts, it’s perceived as zero-sum.

The Legal Fight Over Voting Rights During The Pandemic Is Getting Hotter

Or as former Wisconsin Gov. Scott Walker, a Republican, told NPR, there are no “fair” maps in the discussion about how to draw voting districts — because what Democrats call “fair” maps are those, he believes, that favor them.

No, say voting rights groups and many Democrats — the only “fair” way to conduct an election is to admit as many voters as possible. Georgia Democrat Stacey Abrams, who has charged authorities in her home state with suppressing turnout, named her public interest group “Fair Fight Action.”

Access vs. security

The pandemic has added another layer of complexity with the new emphasis it has put on voting by mail. President Trump says he opposes expanding voting by mail and his allies, including White House press secretary Kayleigh McEnany, call it rife with opportunities for fraud.

Even so, Trump and McEnany both voted by mail this year in Florida, and Republican officials around the country have encouraged voting by mail too.

Democrats, who have made election security and voting access a big part of their political brand for several years, argue that the pandemic might otherwise discourage people from going to old-fashioned polling sites.

Need A Witness For Your Mail-In Ballot? New Pandemic Lawsuits Challenge Old Rules

If there’s rough agreement about that away from the White House, there are many disputes about the specifics — what practices will be permitted based on what the parties perceive as beneficial for them.

A study by Stanford University found that voting by mail yielded a small but roughly equal increase in turnout between the parties.

Ballot Printers Increase Capacity To Prepare For Mail Voting Surge

It isn’t clear yet how much voting by mail might expand by Election Day but it’s the subject of lawsuits around the country; apart from the politics, absentee ballot-printing is a boutique business and its capacity will be tested — as may that of the Postal Service.

How common is voter fraud?

It exists, but it’s also very rare.

Despite anecdotal cases of people voting fraudulently in person or suspicious ballots appearing in the mail, most of the time, in most places, the way elections in the U.S. are processed is legitimate.

'It's Partly On Me': GOP Official Says Fraud Warnings Hamper Vote-By-Mail Push

Since the pandemic, some Republican officials at the state level have acknowledged that the party’s language around fraud may now be putting voters at risk by amplifying fraud concerns out of proportion with the amount of fraud that exists.

Why Is Voting By Mail (Suddenly) Controversial? Here's What You Need To Know

Read more from NPR’s Miles Parks about the integrity of voting by mail.

Trump sometimes claims that large numbers of people vote illegally in the United States, but a panel he appointed to investigate that ostensible problem could not substantiate it. Listen to an interview with a member of that commission.

Anecdotal cases of fraud crop up around the country.

Voter suppression

Activists frequently call out what they term suppression.

In a dispute this spring in Nevada, for example, Democrats sued to stop the state from sending mail-in ballots only to people who had voted in recent elections, rather than all registered voters in the state.

Coronavirus Likely To Supercharge Election-Year Lawsuits Over Voting Rights

Democrats said the state’s plan would disenfranchise some citizens by leaving them out of the primary; Republicans argued states’ voter rolls are often inaccurate and sending out ballots to everyone on them can mean they get lost or wind up in the wrong hands — opening up the prospect for fraud.

Voter rolls are often the focus of disputes for these reasons.

People die, move — and move out of state — and so authorities periodically need to delete names. How frequently that happens, and for what reasons, can become controversial and the kernel of legal and political warfare between the parties.

Likewise with voter identification documents.

In Texas, for example, the Republican-dominated state legislature deemed that handgun licenses were acceptable for voters showing up at the polls — but not student IDs, even those issued by the state’s own universities.

Pandemic Puts A Crimp On Voter Registration, Potentially Altering Electorate

For all the discussion about the effect of voter ID laws, however, a study last year found that whatever impact those laws might have is offset by increased organization and activism by nonwhite voters — leading to no change in registration or turnout.

Another battleground is early and absentee voting. Rules vary by state, with some requiring more explanation than others as to what’s permissible.

Bitter lessons

The parties today have arrived at this moment after years of what they’d argue were bad experiences with elections at the hands of their opponents.

Republicans, among other things, sometimes point to what they believe was cheating in the 1960 presidential race. Alleged Democratic chicanery, in this telling, threw the results to John F. Kennedy and cost the race for Richard Nixon.

Fraudulent IDs, undocumented immigrants voting, people being “bused in” on Election Day — these remain consistent themes when Republicans talk about elections.

Democrats look to the decades of Jim Crow discrimination that kept many black voters out of elections.

More recently, they look at the Supreme Court’s 2000 decision that handed the outcome of that election to George W. Bush over Al Gore. The court halted the counting of ballots Democrats argued could have changed Florida’s results, swinging the state to Gore.

Abrams’ group perceives what it calls a deliberate campaign by the establishment to purge Georgia voter rolls of mainly black or Democratic voters.

Problems with voting in Georgia’s primary in June underscored those problems and that history, Abrams and other critics said.

Voters in Georgia are facing outrageous voter suppression resulting from years of election system sabotage by Republican lawmakers. If Republicans actually wanted you to vote, they would support #VoteByMail and hand-marked #PaperBallots. https://t.co/L6WFHKUlne

Matters of principle

Many party leaders describe at having arrived at their positions based upon principle. Republicans are more likely to argue that casting a vote is a privilege of citizenship to be earned and safeguarded with restrictions and security.

They also point to what they call the principles of federalism and the need for people to be engaged at the state and local level with the conduct of elections — not for broad mandates from Washington.

Democrats are more likely to argue that voting is a right and that the barriers to casting a ballot should be as low as practical. President Lyndon Johnson and Democrats in the 1960s used the Voting Rights Act and federal power to dismantle racist state laws designed to prevent African Americans from voters, but those actions were later weakened by the Supreme Court.

Sen. Elizabeth Warren Calls For National Voting Overhaul

Some current Democrats, including Massachusetts Sen. Elizabeth Warren, have called for new action by Congress and the federal government that could involve new funding, legislation and administration from Washington.

Whatever the outcome of this year’s election, these disputes over elections themselves likely will continue well into the future.

On Tuesday, Texas Attorney General Ken Paxton’s (R) office released a letter arguing that a Texas law governing who may acquire an absentee tally should be read very narrowly– so directly that it could potentially disenfranchise countless citizens during the coronavirus pandemic.

The letter went even further than that, threatening criminal prosecutions versus activists who motivate many more youthful citizens to vote absentee.

The next day, a state trial judge in Austin turned down Paxton’s reading of this absentee ballot law, holding that Texas citizens need to have broad access to absentee ballots throughout the pandemic. However it is far from clear that Judge Tim Sulak’s order will endure contact with higher Texas courts.

That case is called Texas Democratic Party v. Debeauvoir

All 9 justices on the Texas Supreme Court are Republicans, so there is a very high possibility that Paxton’s narrow reading of the law will prevail if Texas Democratic Party reaches the state supreme court. Paxton is commonly expected to appeal Judge Sulak’s decision.

Texas is one of a minority of states that does not permit citizens to obtain an absentee tally for any reason they pick. In Texas, citizens over the age of 65 might get such a ballot merely by asking for one, but more youthful citizens may only get an absentee ballot under a restricted set of situations.

The law does allow voters under the age of 65 to obtain an absentee ballot if they have a “illness or physical condition,” however Paxton’s workplace claims that voters under the age of 65 need to actually be ill in order to get a tally. As they read the law, it’s inadequate if a citizen is stuck at house in order to avoid ending up being contaminated.

Due to the fact that older voters tend to favor Republican prospects, Texas’s odd legal routine, where older voters might have a simple time voting from house while more youthful citizens could have a hard time to obtain a ballot, might supply a substantial unreasonable advantage to Republicans if the coronavirus pandemic still requires most Texans to remain in the house on Election Day.

Moreover, the Texas law can plausibly be read in one of 2 methods– implying that the Republican-controlled state supreme court might quickly pick the reading that is best for the GOP.

Texas’s law is unclear

The specific law at concern in the Texas Democratic Party case supplies that “a certified voter is eligible for early voting by mail if the voter has a sickness or physical condition that prevents the voter from appearing at the ballot place on Election Day without a possibility of needing individual assistance or of injuring the citizen’s health.” The case turns on the proper reading of the words “physical condition.”

A group of civil rights attorneys led by the ACLU proposed reading this law broadly in a brief filed in the Texas Democratic Celebration case.

Paxton’s workplace, on the other hand, argues in a letter signed by Deputy Chief law officer Ryan Vassar, that “an affordable fear of contracting the virus” is not a legitimate reason to get an absentee tally because “an individual’s worry of contracting COVID-19” is merely a “mental” condition– not a “physical” one.

Vassar’s argument rests on an incorrect difference, and it is not a specifically possible way of checking out the state law: The same individual can at the same time have the physical condition of being vulnerable to the coronavirus and the mental condition of being afraid of contracting the coronavirus.

Typically, when a law uses a general term in the context of other, more specific terms, courts will assume that the general term needs to be offered a narrow reading– one comparable to the specific terms.
Frequently, when there are two possible methods to check out a statute and one of those readings weakens an essential constitutional right, courts will pick the reading that leaves that ideal intact.

However it is far from clear that the Texas Supreme Court, with its entirely Republican membership, will pick to maintain ballot rights here.

Paxton is determined to assault the right to vote

Texas’s attorney general, on the other hand, appears figured out to fight for a narrow reading of the state’s absentee ballot law. In a statement released quickly after Judge Sulak’s choice, Paxton declared that “this illegal expansion of mail-in voting will only serve to undermine the security and stability of our elections and to help with scams.”

In truth, however, the overwhelming majority of states allow citizens to obtain an absentee ballot without having to justify that demand. Only 7 states– Texas, Louisiana, Mississippi, Tennessee, Kentucky, Indiana, and South Carolina– have laws restricting access to absentee ballots for individuals under a certain age, according to the advocacy group Vote in your home.

So Paxton is effectively arguing that the legal routine that exists in the large majority of states is a threat to election security and an invitation to scams.

The attorney general’s office, in other words, appears to be threatening criminal prosecutions versus any company that motivates healthy citizens to look for an absentee ballot.

In the most likely occasion that Paxton dominates prior to Texas’s Republican Supreme Court, additionally, the stakes are simply huge. If voters remain on lockdown this November, millions of Texans could be disenfranchised if they can not acquire absentee ballots.
