TikTok threatened legal action against an executive order issued by President Donald Trump Thursday that would ban the Chinese social media app from doing business with U.S. firms.

The app has been at the center of an escalating technology war between the U.S. and China this year. Washington had already threatened to ban TikTok in the U.S. due to national security concerns.

It is concerned the app could allow Beijing to spy on U.S. government employees and contractors, collect personal data for “blackmail,” conduct corporate espionage and be used for “disinformation campaigns” that benefit the Chinese government.

TikTok has denied such allegations and Beijing has opposed the executive orders, saying it will defend the legitimate rights and interests of Chinese businesses.

‘No due process’

TikTok said it was “shocked” by the order, claiming there has been “no due process or adherence to the law” from the Trump administration.

“This Executive Order risks undermining global businesses’ trust in the United States’ commitment to the rule of law, which has served as a magnet for investment and spurred decades of American economic growth,” TikTok said in a blog post.

“And it sets a dangerous precedent for the concept of free expression and open markets. We will pursue all remedies available to us in order to ensure that the rule of law is not discarded and that our company and our users are treated fairly — if not by the Administration, then by the US courts.”

TikTok, which is owned by Beijing-based internet giant Bytedance, wasn’t the only Chinese company targeted by the Trump administration Thursday. Another executive order centers on WeChat, the popular messaging app owned by Tencent, claiming its data collection could give Beijing access to Americans’ personal information.

The bans on TikTok and WeChat are set to take effect in 45 days.

Tencent is arguably a more significant target than ByteDance as its WeChat app is used by millions internationally and the company owns or invests in several major U.S. gaming companies including Riot Games, Epic Games and Activision Blizzard.

It’s still not clear whether the executive order could affect Tencent’s other business dealings.

“We are reviewing the executive order to get a full understanding,” the company told CNBC’s Eunice Yoon in a statement.

TikTok has become a global cultural phenomenon and is especially popular with teens and young adults, who use it to share short-form videos including everything from lip-syncing to comedy.

Despite being Chinese-owned, TikTok has a U.S. CEO and its largest office is based in Los Angeles. ByteDance operates a separate version of the app for China called Douyin.

China on Wednesday condemned what it called an “unprecedented escalation” by the United States and threatened to retaliate after it was ordered to close the Chinese consulate in Houston.

Chinese foreign ministry spokesman Wang Wenbin said in a daily news briefing that the government had been told without warning Tuesday to close the consulate.

He said the consulate had been operating normally Tuesday and called the alleged move an “unprecedented escalation,” the South China Morning Post reported.

“China demands the US revoke the wrong decision. If the US went ahead, China would take necessary countermeasures,” Wang said.

In a statement sent to Fox News, State Department Spokesperson Morgan Ortagus confirmed the directive and said it was issued “to protect American intellectual property and American’s private information.”

The U.S. “will not tolerate the PRC’s violations of our sovereignty and intimidation of our people, just as we have not tolerated the PRC’s unfair trade practices, theft of American jobs, and other egregious behavior,” he added. “President Trump insists on fairness and reciprocity in U.S.-China relations.”

Documents were burned inside the consulate’s courtyard Tuesday evening, KPRC-TV in Houston reported.

“You could just smell the paper burning,” a witness told the station. “But, all the firefighters were just surrounding the building. They couldn’t go inside.”

“The US asked China to close Consulate General in Houston in 72 hours. This is a crazy move,” Hu Xijin, Editor-in-Chief of the Global Times wrote on Twitter.

KPRC reported that the consulate was ordered to close by Friday along with a compound where many consulate employees live, citing police sources.

President Donald Trump has threatened to send more federal law enforcement officers to major US cities to control ongoing protests.

Mr Trump on Monday criticised a number of cities run by “liberal Democrats”, including Chicago and New York, saying their leaders were afraid to act.

He said officers sent to Oregon had done a “fantastic job” restoring order amid days of protests in Portland.

Local officials say the federal officers are making matters worse.

State leaders have demanded Mr Trump remove the personnel from Portland, accusing him of escalating the situation as a political stunt in an election year.

Speaking at the White House on Monday, Mr Trump reiterated his call for law and order.

“We’re sending law enforcement,” he told reporters. “We can’t let this happen to the cities.”

He specifically named New York City, Chicago, Philadelphia, Detroit, Baltimore and Oakland in discussing problems with violence.

“We’re not going to let this happen in our country, all run by liberal Democrats.”

Mr Trump also praised the controversial federal law enforcement efforts in Portland. The city has seen ongoing protests against police brutality in the city since the death of George Floyd, an unarmed black man, in Minnesota in May.

Mr Trump deployed the personnel to the US west coast city two weeks ago to quell the civil unrest.

Some officers have used unmarked cars and worn military-style camouflage on the streets, sparking condemnation from Democrats and activists. In the past week, tensions between protesters and these officers has escalated, and local leaders have called for the federal personnel to leave the city.

Mr Trump said Oregon’s governor, Portland’s mayor and other state lawmakers were scared of the “anarchists”.

“They’re afraid of these people,” he said. “That’s the reason they don’t want us to help them.”

He added: “[Federal officers] have been there three days and they really have done a fantastic job in a very short period of time, no problem. They grab a lot of people and jail the leaders. These are anarchists.”

The officers are part of a new Department of Homeland Security (DHS) unit made up of people from the US Marshals Service and Customs and Border Protection.

They have been deployed under an executive order protecting statues, signed by Mr Trump last month. That order allows federal officers to be deployed without the permission of individual US states.

DHS is also planning to deploy some 150 agents to Chicago this week, the Chicago Tribune reported on Monday. The agents will reportedly assist other federal law enforcement officers and Chicago police in fighting crime.

The president has long accused Chicago’s leaders of failing to control violent crime in the Illinois city, where just last weekend police said 64 people were shot, 11 fatally.

Chicago Mayor Lori Lightfoot had earlier said she was concerned about Mr Trump deploying federal officers to the city. She said she had spoken with Portland’s mayor on Sunday “to get a sense of what’s happened there”.

“We don’t need federal agents without any insignia taking people off the streets and holding them, I think, unlawfully,” Ms Lightfoot said.

Speaking to CNN on Sunday, Portland Mayor Ted Wheeler said there were “dozens if not hundreds of federal troops” in the city, adding: “Their presence here is actually leading to more violence and more vandalism.

“They’re not wanted here. We haven’t asked them here. In fact, we want them to leave,” he said.

Oregon’s attorney general has filed a lawsuit against the federal government for allegedly unlawfully detaining protesters and violating their constitutional rights of assembly and due process.

President Donald Trump on Monday threatened to send federal law-enforcement officials into cities like New York and Chicago following his deployment of such forces to Portland, Oregon, over the weekend to crack down on protesters.

“New York and Chicago and Philadelphia, Detroit, and Baltimore and all of these—Oakland is a mess—we are not going to let this happen in the country, all run by liberal Democrats,” the president told reporters in the Oval Office. “We’re going to have more federal law enforcement, that I can tell you.”

In defiance of both state and local governments, Trump over the weekend escalated operations against protesters in Oregon, with Customs and Border Patrol agents snatching demonstrators off the streets and putting them into unmarked vans for detentions. The state’s attorney general filed a lawsuit against the feds, accusing them of unlawfully detaining protesters. The ACLU has also sued federal agents and local law enforcement, calling the situation a “constitutional crisis.”

Nevertheless, Trump on Monday cheered the feds’ encroachment into Portland while threatening to do the same in other cities: “They’ve done a fantastic job, been there three days, and they have done a fantastic job in a very short period of time, no problem. A lot of people in jail, these are anarchists. These are not protesters. These are people that hate our country. We are not going to let it go forward.”

New York Governor Andrew Cuomo has threatened to reverse New York City‘s reopening plan and close all bars and restaurants because too many are allowing large groups to gather. 

The infection rate of people tested in New York City is now just 1.3 percent, with Brooklyn (0.9 percent) and Manhattan (1.1 percent) showing lower numbers than any other borough. 

Statewide, hospitalizations have fallen to their lowest since March 18 – 716 – and the three-day average of the number of people dying every day is now 11. 

Despite the encouraging numbers, Cuomo says there are still too many young people, particularly in the city, flouting social distancing rules. 

They are ‘reckless and stupid’, he said, but the bar and restaurant owners who are allowing them to gather and the cops who are turning a blind eye to them are also to blame. 

Bars and restaurants in New York City were finally allowed to offer outdoor service on June 22 after an excruciating, 14-week closure that crippled the economy and put many out of business. Indoor dining is indefinitely postponed, due in part to the huge surge in cases being seen in other states where it was allowed to resume.

On Monday, Cuomo warned: ‘We cannot allow those congregations to continue. 

‘If it happens… I’ll tell you what’s going to happen. 

‘We will have to roll back the bar and restaurant opening if the congregations continue, if the local governments don’t stop it, that is what is going to happen. 

‘One plus one still equals two,’ he said.  

He showed photos of crowds at bars in Astoria, Queens, and on the Lower East Side as examples, but large gatherings have been seen all over the city. 

Statewide: 1.05% positive of 49,342 people tested positive (519). 

Bars and restaurants were allowed to resume outdoor dining on June 22. 

Many had been offering take-out throughout the pandemic which created a problem of people gathering in streets with drinks.

Last week, Cuomo tightened the rules.

Now, anyone who sits down at an outdoor bar or restaurant must order food with their alcohol drinks. 

While many have adhered to the rules strictly, others have flouted them. 

The White Horse Tavern in the West Village had its liquor license suspended for repeatedly violating social distancing rules. 

Others, like Lola Taverna in Soho, have been the subject of complaints from New Yorkers. 

Last week, a worrying number of ‘mask-free pandemic parties’ popped up all over the city. 

They were secretly promoted on WhatsApp and involved huge crowds of youngsters showing up at the parties to dance along to music by DJs. 

New York had by far the highest number of cases in the US at its worst in March and April. 

Now, as cases continue to soar in other states which were more relaxed in their approach to lockdown, Cuomo is taking his tactics to them to try to help. 

On Monday, he and a team of delegates departed for Georgia. 

His repeated boasts about flattening New York’s curve has enraged conservatives who blame him for the initial surge in cases.

China on Wednesday promised to retaliate against “U.S. institutions and individuals” after President Trump signed legislation and an executive order sanctioning Beijing for imposing a sweeping new national security law on Hong Kong.

Trump on Tuesday signed the Hong Kong Autonomy Act, which approves sanctions on Chinese officials and banks, as well as an executive order ending Hong Kong’s preferential trade treatment.

“Today I signed legislation, and an executive order to hold China accountable for its aggressive actions against the people of Hong Kong,” Trump told reporters at the White House Rose Garden.

“Hong Kong will now be treated the same as mainland China,” he said. “No special privileges, no special economic treatment and no export of sensitive technologies.”

China’s foreign ministry condemned the move, saying Beijing would protect “its legitimate interests” by imposing sanctions “against related U.S. institutions and individuals.”

Although the foreign ministry did not elaborate, Maryland Democrat Sen. Chris Van Hollen and Pennsylvania Republican Sen. Patrick Toomey, who introduced the Hong Kong Autonomy Act, were likely to be among the sanctioned individuals, Chen Long, a partner at the independent research agency Plenum, told the Hong Kong-based South China Morning Post.

Hong Kong, a former British colony, reverted to Chinese control in 1997 under an agreement with London that was to have guaranteed a “high degree of autonomy” for the territory, including substantial political freedoms, for a period of 50 years.

However, Beijing has slowly eroded those freedoms and reneged on promises for more representative government in Hong Kong. Mass protests in 2014 and again in recent months in Hong Kong have opposed what activists see as Beijing’s heavy handling of the territory. Late last month Beijing imposed the national security law, which criminalizes — in the words of the law — secession, subversion of state power, terrorism and collusion with foreign entities, with penalties of up to life in prison.

The Hong Kong Autonomy Act and Trump’s executive order eliminate special treatment for Hong Kong passport holders and end an extradition agreement between Hong Kong and the U.S. The executive order eliminates joint U.S.-Hong Kong police training and revokes license exceptions for exports to Hong Kong.

It also ends cooperation between U.S. and Chinese agencies, such as the U.S. Geological Survey.

The Trump administration’s latest moves against Beijing follow a souring of relations that has come amid the spread of the COVID-19 pandemic, which originated in central China and has since spread globally, infecting and killing more people in the U.S. than in any other country.

Washington blames China for covering up the extent of the outbreak in its earliest days and Trump has even suggested that the virus may have escaped from a Chinese lab, a scenario widely dismissed by scientists.

On Monday, the Trump administration rejected Beijing’s maritime claims in the South China Sea, a long-running conflict between China and several Southeast Asian countries over control of key islands in the region.

“We are making clear: Beijing’s claims to offshore resources across most of the South China Sea are completely unlawful, as is its campaign of bullying to control them,” Secretary of State Mike Pompeo said in a statement.

Just prior to the pandemic, Trump had praised China’s President Xi Jinping after the two leaders negotiated a Phase 1 trade deal. However, at Tuesday’s White House news conference, Trump said he had no interest in talking with Xi.

President Trump issued a warning Sunday morning to anyone who even attempts to harm federal monuments, including the Lincoln or Jefferson Memorials, saying that they will automatically face a substantial prison term.

Historic monuments and statues have become the targets of anger and vandalism during protests in the wake of George Floyd‘s death while in police custody at the end of May. The initial statues under fire were those of Confederate soldiers and generals largely in the South, but the anger has spread to monuments well beyond that historical period.

TRUMP ANNOUNCES FORTHCOMING EXECUTIVE ORDER TO ‘MAKE THE CITIES GUARD THEIR MONUMENTS’

“No, Radical Left anarchists, agitators, looters or protesters will not be knocking down or harming the Washington Monument, the Lincoln or Jefferson Memorials,” Trump tweeted. “If they even try, an automatic 10 years in prison. Sorry!” Trump’s warning included “just about any other” federal statues or monuments as well.

Trump has been vocal about protecting monuments and punishing vandals, especially following incidents involving a monument of Andrew Jackson and vandalism at the Lincoln Memorial, World War II Memorial and St. John’s Church.

Under the Veterans’ Memorial Preservation Act, offenders can face up to 10 years behind bars and a fine for damaging or attempts to damage “any structure, plaque, statue, or other monument on public property commemorating the service of any person or persons in the armed forces of the United States.”

In his push to get schools and colleges to reopen this fall, President Donald Trump is again taking aim at their finances, this time threatening their tax-exempt status.

Trump said on Twitter on Friday he was ordering the Treasury Department to re-examine the tax-exempt status of schools that he says provide “radical indoctrination” instead of education.

“Too many Universities and School Systems are about Radical Left Indoctrination, not Education,” he tweeted. “Therefore, I am telling the Treasury Department to re-examine their Tax-Exempt Status and/or Funding, which will be taken away if this Propaganda or Act Against Public Policy continues. Our children must be Educated, not Indoctrinated!”

The Republican president did not explain what prompted the remark or which schools would be reviewed. But the threat is just one more that Trump has issued against schools as he ratchets up pressure to get them to open this fall. Twice this week Trump threatened to cut federal funding for schools that don’t reopen, including in an earlier tweet on Friday.

It’s unclear, however, on what grounds Trump could have a school’s tax-exempt status terminated. It was also not clear what Trump meant by “radical indoctrination” or who would decide what type of activity that includes. The White House and Treasury Department did not immediately comment on the president’s message.

Previous guidance from the Internal Revenue Service lays out six types of activities that can jeopardize a nonprofit organization’s tax-exempt status, including political activity, lobbying and straying from the organization’s stated purpose.

But ideology is not on the IRS’s list, said Terry Hartle, senior vice president of the American Council on Education, which represents university presidents. Any review of a school’s status would have to follow previously established guidelines, he said.

“It’s always deeply troubling to have the president single out schools, colleges or universities in a tweet,” Hartle said. “Having said that, I don’t think anything will come of this quickly.”

In his latest threat, Trump revived his oft-repeated claim that universities are bastions of liberalism that stifle conservative ideas. He used the same argument last year when he issued an executive order telling colleges to ensure free speech on campuses or lose federal research funding.

His interest in colleges’ finances appears to have been renewed as several schools sue the Trump administration over new restrictions on international students. Harvard University and the Massachusetts Institute of Technology sued to block the policy earlier this week, followed by Johns Hopkins University on Friday. The University of California system has said it also plans to sue.

The universities are challenging new guidance issued by Immigration and Customs Enforcement saying international students cannot stay in the U.S. if they take all their classes online this fall. The policy has been viewed as an attempt to force the nation’s universities to resume classroom instruction this fall.

Under the rules, international students must transfer schools or leave the country if their colleges plan to hold instruction entirely online. Even if their schools offer a mix of online and in-person classes, foreign students would be forbidden from taking all their courses remotely.

The lawsuit from Harvard and MIT argue that the policy breaks from a promise ICE made in March to suspend limits around online education “for the duration of the emergency.”

Until Friday, Trump had mostly focused his efforts on reopening elementary and secondary schools as millions of parents wait to find out if their children will be in school this fall. He has insisted that they can open safely, and in a Friday tweet argued that virtual learning has been “terrible” compared with in-person instruction.

“Not even close! Schools must be open in the Fall. If not open, why would the Federal Government give Funding? It won’t!!!” he wrote. Trump issued a similar warning on Twitter on Wednesday, saying other nations had successfully opened schools and that a fall reopening is “important for the children and families. May cut off funding if not open!”

Trump has not said what funding he would withhold or under what authority. But White House spokeswoman Kayleigh McEnany has said the president wants to use future coronavirus relief funding as leverage. McEnany said Trump wants to “substantially bump up money for education” in the next relief package, but only for schools that reopen.

“He is looking at potentially redirecting that to make sure it goes to the student,” McEnany said at a Wednesday press briefing. She added that the funding would be “tied to the student and not to a district where schools are closed.”

But Trump’s control over school funding is limited. The vast majority of funding for public elementary and secondary schools comes from state and local sources, and nonprofit colleges are more likely to rely on tuition or state aid than federal money.

His threats to withhold funding have been denounced by a growing array of education and health groups, including a medical association that the White House has repeatedly cited in its press to reopen schools.

In a joint statement with national education unions and a superintendents group, the American Academy of Pediatrics on Friday said decisions should be made by health experts and local leaders. The groups argued that schools will need more money to reopen safely during the coronavirus pandemic and that cuts could ultimately harm students.

“Public health agencies must make recommendations based on evidence, not politics,” the groups wrote. “Withholding funding from schools that do not open in person full-time would be a misguided approach, putting already financially strapped schools in an impossible position that would threaten the health of students and teachers.”

The American Academy of Pediatrics has supported a fall reopening, saying in June guidelines that schools should strive to start the academic year with their students “physically present in school.” Vice President Mike Pence, Education Secretary Betsy DeVos and McEnany have repeatedly, and as recently as Wednesday, cited the group in defense of Trump’s approach.

But Friday’s statement acknowledged that it may be best for some schools to stay online. School leaders, health experts, teachers and parents should be at the center of reopening decisions, the groups said, “taking into account the spread of COVID-19 in their communities and the capacities of school districts to adapt safety protocols to make in-person learning safe and feasible.”

Some districts have already announced plans for only a partial reopening, with a mix of in-person and online instruction. New York City’s public school district, the nation’s largest, said students will be in classrooms two or three times a week and learn remotely between. DeVos has opposed that kind of approach, saying it fails students and taxpayers.

Determined to reopen America’s schools despite coronavirus worries, President Trump threatened Wednesday to hold back federal money if school districts don’t bring their students back in the fall. He complained that his own public health officials’ safety guidelines are impractical and too expensive.

Shortly afterward, Vice President Mike Pence announced that the Centers for Disease Control and Prevention would be issuing new guidance next week “that will give all new tools to our schools.” The advice will keep students safe, he said, but “the president said today we just don’t want the guidance to be too tough.”

Despite Trump’s increased his pressure on state and local officials, New York City announced that most of its students would return to classrooms only two or three days a week and would learn online in between. “Most schools will not be able to have all their kids in school at the same time,” said Mayor Bill de Blasio.

For a nation that prides itself on its public school system, it’s a newly extraordinary situation in this pandemic-ridden year.

With millions of the nation’s parents anxious about their children’s safety in the fall — and their own work interruptions if they must stay home — Trump continued to inject politics into public health. He accused Democrats yet again of wanting to keep schools closed for election-year reasons rather than health concerns. And he issued a veiled threat to CDC officials over their reopening guidelines, saying, “I will be meeting with them!!!”

Safety problems can be surmounted, he insisted, and reopening schools “is important for the children & families. May cut off funding if not open!”

He did not say what funding he would pull, but Pence suggested at a coronavirus task force briefing that future COVID-19 relief bills could be tied to reopening schools as one way “to give states a strong incentive and encouragement to get kids back in school.”

On Twitter, Trump argued that countries including Germany, Denmark and Norway have reopened schools “with no problems.”

Germany did begin to reopen its schools in May, but in many cases students are taking turns going to school and studying at home for half the week — just the thing that administration officials have criticized. Authorities are aiming for classes to resume in close to normal fashion after the summer vacation.

Trump’s Twitter warnings drew a backlash from some governors who said he has no authority over schools’ fall plans. New York Gov. Andrew Cuomo, a Democrat, said officials will reopen when it’s safe to do so.

“School reopenings are a state decision, period,” he said at a news conference. “That is the law, and that is the way we are going to proceed. It’s not up to the president of the United States.”

Trump made his threat a day after launching an all-out effort pressing state and local officials to reopen the nation’s schools and colleges this fall. At a White House event Tuesday, health and education officials argued that keeping students out for the fall semester would pose greater health risks than any tied to the coronavirus.

Among those pushing for a fall reopening was the chief of the CDC. But Trump on Wednesday complained that the agency’s school opening guidelines were too tough and costly.

“While they want them open, they are asking schools to do very impractical things,” Trump wrote.

The CDC’s director, Dr. Robert Redfield, has emphasized that his agency’s guidelines are only recommendations.

“I want to make it very clear that what is not the intent of CDC’s guidelines is to be used as a rationale to keep schools closed,” he said at Wednesday’s coronavirus task force briefing, which was held at the Education Department.

The CDC’s guidance recommends that students and teachers wear masks whenever feasible, spread out desks, stagger schedules, eat meals in classrooms instead of the cafeteria and add physical barriers between bathroom sinks.

Trump did not clarify which of the guidelines he opposed. Pence did not indicate whether they are being revised in response to the president’s objections.

At the briefing, and a day earlier in a call with the nation’s governors, Education Secretary Betsy DeVos said anything less than a full reopening would be a failure for students and taxpayers. But some of the nation’s largest districts plan to bring back limited numbers of students for only a few days a week, saying it would be unsafe for all to return at once.

She singled out Virginia’s Fairfax County Public Schools, which are asking families to decide between fully remote instruction or two days a week at school.

“A choice of two days per week in the classroom is not a choice at all,” DeVos said, according to audio of the call with governors obtained by the Associated Press.

In announcing New York City’s plan for in-person instruction two or three days a week, De Blasio said schools can’t accommodate all their students at any one time while maintaining social distancing. The city’s public school system, with 1.1 million students, is by far the nation’s largest.

Trump said at the White House event Tuesday, “We’re very much going to put pressure on governors and everybody else to open the schools.” He said that parents and children want schools to reopen and “it’s time to do it.”

But the president of the nation’s largest education union said Trump was more interested in scoring points for the November election than in keeping students safe.

“Trump has proven to be incapable of grasping that people are dying — that more than 130,000 Americans have already died,” said Lily Eskelsen García, president of the National Education Assn. “Educators want nothing more than to be back in classrooms and on college campuses with our students, but we must do it in a way that keeps students, educators and communities safe.”

The American Academy of Pediatrics recently issued guidelines suggesting that schools aim to start the academic year with students “physically present in school.” Keeping students at home can lead to social isolation, the organization said, and prevent schools from identifying learning deficits, abuse, depression and other issues.
