The Trump campaign filed a lawsuit over the weekend challenging North Carolina’s new lenient vote-by-mail procedures, arguing the changes written by the Board of Elections open the door to fraud and violate the state’s own laws.

It’s the latest lawsuit by the Trump team, and it follows warnings from President Trump that a rush to make voting easier amid the coronavirus pandemic has created opportunities for massive fraud.

In the case of North Carolina, the president’s campaign objects to new rules — purportedly reached in a “backroom deal” — that allow voters to “cure” ballots found to have errors by signing an affidavit, rather than having to start over and cast a new ballot.

The new rules were released last week, even though hundreds of thousands of ballots had already been sent out under the old rules, and more than 200,000 had already been completed and returned by Saturday, the Trump campaign said.

They asked a federal judge to issue a temporary restraining order halting the new rules.

North Carolina Attorney General Joshua H. Stein, in a response Monday, called the claims “factually and legally baseless.”

He also accused the Trump team of court-shopping by bringing the lawsuit in the U.S. District Court for the Eastern District of North Carolina. He said cases involving other challenges to the state’s election procedures are being heard in the Middle District, but those rulings haven’t been to the Trump team’s liking.

The Trump campaign and Republican National Committee have now sued five states over their new voting rules this year. In addition to North Carolina, they are Montana, New Jersey, Nevada and Pennsylvania. They have also sued some Iowa counties.

In a move that defies federal health guidelines, North Dakota announced late Thursday, Sept. 24, that interim State Health Officer Paul Mariani has rescinded an order that required close contacts of known COVID-19 cases to quarantine.

The order, which Mariani expanded Wednesday, mandated that residents identified as close contacts quarantine at home for 14 days or risk facing Class B misdemeanor charges. The department defines a close contact as a person who was within six feet of a known COVID-19 case for at least 15 minutes.

Republican Gov. Doug Burgum said in a Thursday news release “we need a light touch of government with more local leadership and collaboration, and we feel we can better support those efforts by working more closely with local public health and community leaders to identify mitigation strategies that will work and be supported in each community.”

Burgum said while announcing the amended order Wednesday that the move was made to align with guidelines set by the Centers for Disease Control and Prevention.

With the order now declared null, North Dakota is again out of step with CDC guidelines. The agency’s website says close contacts should get tested for COVID-19, and “asymptomatic contacts testing negative should self-quarantine for 14 days from their last exposure.”

Burgum noted Wednesday that it is extremely important that close contacts stay away from other members of the public because as many as a third of all close contacts identified by contact tracers ended up testing positive for the illness. Health officials have said in the past that residents refusing to comply with requests to quarantine has been a serious issue.

Mariani said close contacts should still avoid others “whenever possible,” adding “we continue to stress the importance of quarantining and isolation to bend the curve back in the right direction in North Dakota.”

The original order issued by then-State Health Officer Mylynn Tufte in April only required household contacts of known positives to quarantine. A spokeswoman for the Department of Health did not respond in time for publication when asked if the original order remains in effect. A separate order still requires people who have tested positive for COVID-19 to isolate for at least 10 days.

Both versions of the order exempted essential workers as defined by the U.S. Department of Homeland Security.

Local law enforcement would have enforced the quarantine mandate, but Thursday’s release said no one has actually been charged with violating either version of the order.

Thursday’s retraction isn’t the first time during the pandemic the health department has backed off an order just hours after it was issued. Tufte, who later resigned, dramatically weakened a quarantine order for returning travelers in March a day after she declared the mandate.

A third of North Dakota’s total confirmed coronavirus cases have been recorded in the last three weeks, with almost 6,000 cases being reported since the start of September.

This month has also seen a a new monthly record for COVID-19 fatalities, with 45 deaths since September 1. This is two more than the previous highest monthly recorded in May.

In total, North Dakota has had 17,958confirmed cases of COVID-19 since the start of the pandemic. Of these, 5,959 have been identified in September, figures from the North Dakota Department of Health show.

On Saturday, North Dakota reported eight COVID-19-related deaths—all in Morton County—taking its overall total to 192.

On Sunday, the department of health reported 352 new cases across 34 counties, bringing the number of active cases to 3,208—a new record. There were 81 active hospitalizations on Saturday—another new pandemic record for the state—22 of which were in intensive care units.

Currently, North Dakota has the highest rate of infection out of state in the country—312 per 100,000 people, according to The New York Times coronavirus map. The state has a population of around 760,000 people.

But the state has also tested a greater percentage of its population than any other state, and has done so consistently throughout the pandemic, according to the Johns Hopkins Coronavirus Resource Center.

Since mid-August, the state has been conducting an average of around 5,000 tests per day, which means more cases are being uncovered compared to earlier in the pandemic. On Friday, the state reported more than 10,000 tests—a new daily record.

There has been a steady increase of both the number of new daily cases and the test positivity rate—the percentage of tests that come back positive out of the total number conducted—since June and July. This is a sign that prevalence of the disease has risen over this period, Jennifer Horney, an epidemiologist from the University of Delaware, previously told Newsweek.

The test positivity rate has remained relatively stable over the past two weeks, hovering above 5 percent. This is close to the threshold of five percent that the World Health Organization recommends a region should stay at or below for at least 14 days before restrictions can be relaxed.

In North Dakota, the largest proportion of new cases during the current phase of the pandemic have been people aged between 20 and 29, who have a lower mortality rate than higher-risk groups.

North Dakota is one of the few states without a mask mandate. Despite rising cases, Governor Doug Burgum rejected the idea of issuing such a mandate last Friday.

During the pandemic, Burgum has advocated the use of face masks, appealing to a sense of personal responsibility among North Dakotans, in the absence of a state mandate.

Governors and state health officials from across the country have said that the widespread use of masks helps to mitigate the spread of COVID-19.

Alabama Governor Kay Ivey issued a mandatory statewide mask order on July 16, with the state subsequently seeing a notable fall in coronavirus cases. Currently, the seven-day average of new daily cases is hovering just over 880, compared to more than 1,700 on July 16, according to state health department figures.

“The mask absolutely played a very important role and we really have had no other significant limitations or interventions other than the mask,” Scott Harris, state health officer at the Alabama Department of Public Health, told NBC News.

A North Carolina couple passed away moments apart from the coronavirus as they held on to each other’s hand.

Johnny Lee Peoples, 67, and his wife Cathy Darlene Peoples, 65, both died from the virus after a month-long battle with the infection on Sept. 2 at a Salsbury hospital, People reported.

As their time came to an end, the staff at the Novant Health Rowan Regional Medical Center moved the couple into the same room so they could comfort each other with one last goodbye, their son, Shane Peoples, told WBTV.

“Everything just went south, everything just got worse,” he said. “The next day they put them in the same room, same ICU room, they put their hands together, the nurses gathered around and they passed within four minutes of each other.”

The couple had been together for 50 years and married for 48. Shane is now left to grapple with the loss of both parents at once. Their funeral was held Wednesday outside with attendees observing social distancing guidelines.

“It was mainly the fever and loss of taste,” Peoples said, explaining his parents’ early symptoms. “My dad started showing symptoms two days later. About two weeks later they were both put in the ICU.”

Shane reportedly penned a heartfelt Facebook post earlier in the week, writing, “My parents weren’t just a blessing for me, my brother, my sister, our spouses, and our children. They were a blessing to every person that met them. My mom had the most beautiful soul of anyone you could have met.”

He stressed to WBTV that the virus must be taken seriously and urged readers on Facebook to wash their hands, practice social distancing and wear a mask.

“It’s not a joke. It’s not a hoax,” Peoples said. “I just don’t [want] anyone else to get hurt. I don’t [want] anyone to feel the grief that we’re feeling.”

BUTTE COUNTY (CBS13) — The latest on the Bear Fire, an extension of the North Complex Fire that started the Plumas National Forest:

Cal Fire has given a new name to the wildfire that has now destroyed or damaged thousands of structures.

The Bear Fire will now be called the North Complex West Zone by authorities, Cal Fire announced Thursday morning.

It’s unclear why the name was changed, but the new designation reflects how the wildfire is part of the larger North Complex Fire that had been burning for nearly a month before exploding this week.

Cal Fire also listed a total of 2,000 structures being destroyed or damaged as of Thursday morning. It’s unclear how many of those structures were homes at this point. Another 22,356 structures remain threatened.

As of Thursday, the North Complex West Zone/Bear Fire has grown to 70,250 acres. Containment still stands at 0 percent.

7:57 a.m.

Authorities in Butte County Thursday were looking for at least 12 people missing in the Bear Fire after three people were found dead in connection with the fire Wednesday.

One mother, Jessica Williams, reported her 16-year-old son Josiah missing. He was last seen in Berry Creek and, as of Thursday morning, she says she still hasn’t been able to contact him.

Some 20,000 people are under evacuation orders in the area due to the Bear Fire, which is part of the North Complex fires in Butte, Plumas and Yuba counties

After a seriously burst of wind storms, the fire exploded over the past few days after burning for about three weeks. Hundreds of homes and other structures have either been damage or destroyed. As of Thursday morning, the North Complex fires had burned 252,163 acres, or nearly 400 square miles, with containment at 24 percent – down from a high of 51 percent it was before these new starts.

Parts of the communities of Paradise and Concow, which were devastated by the 2018 Camp Fire, are once again being threatened by the Bear Fire.

The U.S. Forest Service says winds were predicted to shift Thursday to the southwest, which could produce increased fire behavior and smoke.

Family and friends gathered Thursday to lay to rest a little North Carolina boy who always had a smile on his face — as the motive for his senseless murder over the weekend remained a mystery.

“[You] can’t imagine what it’s like to hold your son in your arms with a gunshot wound to the head, and his blood is running down your arms,” Austin Hinnant told WRAL-TV before the funeral for his 5-year-old son Cannon.

Darius Sessoms, 25, has been charged with walking up to the boy late Sunday afternoon and shooting him in the head at point-blank range, according to police and witnesses. Cannon was killed as he rode a bike in his father’s front yard in Wilson. The boy’s two sisters, 7 and 8 years old, were with him when he was shot, according to reports.

Hinnant told the station he and Sessoms were next-door neighbors. He had Sessoms over to his house the night before for dinner. They drank a beer together on the porch, he said.

“There wasn’t anything between me and him, any bad blood whatsoever, for him to have a reason to do this,” Hinnant said, the station reported.

He said he ran to Cannon after he heard the gunshot from inside the house.

“I screamed, ‘Somebody, please help me save my son! Help me God save my son, please,'” Hinnant said.

He said he saw Sessoms pacing with a gun in his hand, get in a car and then drive off.

“I was looking at him as I was picking up Cannon,” he said. “I was so full of rage, but I couldn’t leave my son’s side. I wanted to be with my son.”

A police spokesman said Thursday he had no information about a motive for the shooting, according to the station.

Cannon’s funeral Thursday drew hundreds of mourners to the Shingleton Funeral Home in Wilson.

“Cannon was the type of kid that was always polite, kind of laid back, but he was a beautiful little kid,” Cannon’s grandfather, Merrill Race, told the station outside the funeral home.

Police said Sessoms has been charged with first-degree murder and was being held without bail.

WRAL reported interviewing Sessoms’ parents, who said they were deeply saddened by what happened to Cannon.

They said they believe their son was on drugs and having hallucinations at the time of the shooting, the station reported.

A North Carolina dog that died after suffering an “acute illness” earlier this month has tested positive for coronavirus, officials said Monday.

The death could mark a rare, potentially fatal case of COVID-19 in a pet, though it’s still unclear if there were other underlying conditions that contributed to its death.

The dog was brought to the NC State Veterinary Hospital in Raleigh on Aug. 3 after showing signs of respiratory distress earlier that day, the North Carolina Department of Health and Human Services said in a statement.

The person who brought the animal to the hospital told staff members that a family member had previously tested positive for coronavirus, though a later test returned negative results, the department said.

Citing patient confidentiality, the department did not provide additional information about the dog or the person who brought it to the hospital.

The dog died the same day, a department spokeswoman said. Samples taken from the dog that were tested in a diagnostic lab returned a positive result, a result confirmed by the U.S. Department of Agriculture’s National Veterinary Services Laboratory, the statement said.

Investigators were still trying to determine why it died, the statement said.

Only a handful of animals in the United States have contracted the disease, according to a list maintained by the Department of Agriculture. Most of those infections have occurred after contact with people who had coronavirus, according to the Centers for Disease Control and Prevention.

The department says the risk of animals spreading the disease to people remains low.

As of Aug. 7, when the agriculture department’s list was last updated, it had confirmed 13 cases among dogs in eight states, including an earlier positive antibody test in North Carolina. Several cats have also contracted the disease, according to the list. So did eight lions and tigers at the Bronx Zoo.

Last month, National Geographic reported that the first dog to test positive in the United States — a 7-year-old German shepherd from New York named Buddy — died on July 11, six weeks after he was confirmed to have the disease.

The magazine reported that Buddy had lymphoma when he died and it’s unclear how much the cancer and the virus contributed to his death.

Michael San Filippo, a spokesman for the American Veterinary Medical Association, said most dogs that have contracted the disease are asymptomatic or show only slight signs of infection.

That “seems to indicate that this is not a major problem for dogs,” he said. “But we have more to learn, like how it might combine with other conditions to cause more serious problems. We’re still advising caution with keeping pets away from people who are ill, and to practice social distancing with your pet and other pets and people outside your household.”
