LOUISVILLE, Ky. — A juror in the Breonna Taylor case contends that the Kentucky attorney general misrepresented the grand jury’s deliberations and failed to offer the panel the option of indicting the two officers who fatally shot the young woman, according to the juror’s lawyer.

The unnamed juror filed a court motion on Monday seeking the release of last week’s transcripts and permission from a judge to speak publicly to set the record straight. Hours later, the office of Attorney General Daniel Cameron granted both requests, saying that the juror is free to speak and that recordings of the session will be made public.

“This is something where the juror is not seeking any fame, any acclaim, any money,” said Kevin M. Glogower, the juror’s lawyer.

Mr. Glogower said the juror came to him last week in a state of turmoil after Mr. Cameron repeatedly said at a news conference that the law did not permit him to charge Sgt. Jon Mattingly and Detective Myles Cosgrove, the two white officers who shot Ms. Taylor, a Black woman, after one officer was shot by her boyfriend — and that the jury had agreed with him.

“While there are six possible homicide charges under Kentucky law, these charges are not applicable to the facts before us because our investigation showed — and the grand jury agreed — that Mattingly and Cosgrove were justified in the return of deadly fire after having been fired upon,” Mr. Cameron said, one of several moments in the news conference where he emphasized such a consensus.

According to Mr. Glogower, the juror was unsettled by the fact that the grand jury was not given an option of charging the two officers at a time when the community has been roiled by demonstrations seeking their indictment. The 12-member panel was presented only with possible charges for Detective Brett Hankison, who was fired in June.

Mr. Hankison was accused of behaving recklessly when he ran into the parking lot and began shooting through Ms. Taylor’s covered patio door, his bullets flying into a neighbor’s apartment. The grand jury concluded that he had no self-defense claim but that he could not be charged with murder because he did not strike Ms. Taylor; he was charged with three felony counts of wanton endangerment.

Before the charges were announced last week, the city enacted a state of emergency, expecting mass protests. Courthouses shut down and businesses recorded voice mail messages apologizing to patrons for the unexpected closure. More than 200 protesters upset with the decision and demanding justice have been arrested, with some smashing windows and setting fires. One protester fired a gun at least nine times and wounded two police officers.

But legal experts had warned that Kentucky’s vigorous self-defense laws made it unlikely that Sergeant Mattingly and Detective Cosgrove would be indicted on murder charges because Ms. Taylor’s boyfriend, Kenneth Walker, had fired first during the police raid on her apartment. He had mistaken the officers for an intruder when they breached the door.

“We have no concerns with grand jurors sharing their thoughts on our presentation because we are confident in the case we presented,” Elizabeth Kuhn, a spokeswoman for the attorney general, said in an email on Monday night, adding that her office would release the recordings of the deliberations by Wednesday.

Ms. Kuhn said no charges could be recommended for those two officers because the investigation had concluded that their use of force was justified.

“Our prosecutors presented all of the evidence, even though the evidence supported that Sergeant Mattingly and Detective Cosgrove were justified in their use of force after having been fired upon by Kenneth Walker,” she said in an email. “For that reason, the only charge recommended was wanton endangerment.”

One longtime criminal defense lawyer, Ramon McGee, said the question of which charges the attorney general presented to the panel was not problematic.

“That is an incorrect assumption on how the grand jury process works,” he said. “Prosecutors make the decision on what witnesses are called, which evidence is tendered and what charges to recommend,” he said.

But the transcripts should be released, Mr. McGee added, because how the attorney general portrayed the process in public was potentially an issue.

Advocates for Ms. Taylor point to the juror’s complaint as evidence of a broken process, which started with the raid and included the release of an incident report that claimed the dead woman had not been injured. Despite a $12 million settlement from the city of Louisville in a wrongful-death lawsuit, Ms. Taylor’s mother said that nothing short of indicting all three officers would amount to justice.

“This just compounds the trust issue,” said Christopher 2X, a community organizer who was with Tamika Palmer, Ms. Taylor’s mother, last week when the attorney general told her the officers would not be charged. She broke down crying, he said.

LOUISVILLE, Ky. – A former detective with the Louisville police department has been indicted on felony charges of wanton endangerment after shooting into the an apartment next door to Breonna Taylor, the 26-year-old EMT who was killed in her own home by police.

Brett Hankison, who was fired in June, is facing three felony counts and bail was set at $15,000. A warrant has been issued for his arrest.

Two other officers involved in the shooting, Sgt. Jonathan Mattingly and Detective Myles Cosgrove, were justified in their use of force, state Attorney General Daniel Cameron said at news conference. All three fired their weapons at Taylor’s apartment.

A wanton endangerment charge is a class D felony and carries a penalty of one to five years in prison.

The charges read by Judge Annie O’Connell on Wednesday said that Hankison “wantonly shot a gun” into adjoining Apartment 3. The occupants of that apartment were identified by initials. None of them were BT – Breonna Taylor.

That means the grand jury did not find that Hankison wantonly fired into Taylor’s apartment the night she died or that any of the officers are criminally liable in her death.

In May, Taylor’s neighbor, Chesey Napper, filed a lawsuit against the LMPD officers, claiming that the officers’ shots were “blindly fired” and nearly struck a man inside. Napper was pregnant and had a child in the home, according to the lawsuit.

Cameron said Wednesday that the grand jury decided homicide charges are not applicable because the investigation showed that Mattingly and Cosgrove were justified in returning deadly fire after they were fired upon by Kenneth Walker, Taylor’s boyfriend, who has said he didn’t know police were at the door. 

He said there was “nothing conclusive to say” that any of Hankison’s bullets hit Taylor.

“Justice is not often easy and does not fit the mold of public opinion. And it does not conform to shifting standards,” Cameron said. “I know that not everyone will be satisfied with the charges we’ve reported today.

“My team set out to investigate the circumstances surrounding Ms. Taylor’s death. We did it with a singular goal in mind: pursuing the truth. Kentucky deserves no less. The city of Louisville deserves no less. If we simply act on emotion or outrage, there is no justice. Mob justice is not justice.”

Cameron said he would create a task force to review the process of securing, reviewing and executing search warrants in Kentucky. It will be a “top-to-bottom review of the search warrant process,” he said.

Around 200 protesters gathered at Jefferson Square Park in downtown Louisville as the announcement was played on a loudspeaker. They almost immediately began chanting “No justice, no peace.”

“I’m heartbroken,” Logan Cleaver, a protester, said Wednesday immediately after the grand jury’s decision was announced. “This is not a justice system if it’s not for everybody.”

A visibly upset Tamika Palmer, Taylor’s mother, traveled to Cameron’s announcement in Frankfort but left without commenting. Attorneys for the Taylor family said they would not be talking or issuing a statement.

Taylor’s sister, Juniyah Palmer, posted a picture on Instagram of her with Breonna, saying, “Sister, I am so sorry.”

Ben Crump, a nationally renowned civil rights attorney who is representing the Taylor family, tweeted that Hankison should have been charged with “wanton murder.”

“This is outrageous and offensive!” he said.

The announcement comes after Cameron’s office presented its findings to the jury earlier this week. His team has been investigating the Taylor shooting since May.

The uncertainty swirling around the decision on possible criminal charges in Taylor’s death has drawn both local and international attention as protesters have marched and chanted on Louisville’s streets for 119 consecutive days. Protesters in Louisville and supporters across the U.S. have called for “justice for Breonna” and other Black Americans, such as George Floyd in Minneapolis, who have been killed by police. 

In anticipation of Cameron’s announcement, Louisville Mayor Greg Fischer invoked a 72-hour curfew, effective Wednesday night, from 9 p.m. to 6:30 a.m. A week ago, Fischer announced the city agreed to a $12 million settlement with Breonna Taylor’s family that includes more than a dozen police reforms.

Downtown Louisville has taken on the appearance of a city under siege, with plywood nailed across business fronts and concrete barriers cordoning off a 25-block perimeter.

Louisville Metro Police interim Chief Robert Schroeder said the restrictions, long planned amid “unprecedented times,” were meant to protect public safety, property, protesters and avoid conflicts between drivers and demonstrators.

Protesters will still be able to access downtown on foot to demonstrate and retain their First Amendment rights, city officials said.

“I hope all of this is not needed,” Schroeder said.

Through it all, Cameron, a rookie Republican attorney general elected in November 2019 and a protege of Majority Leader Mitch McConnell, has stayed quiet. Until the decision came down Wednesday.

Mattingly, Cosgrove and Hankison have faced intense public scrutiny – and threats – in the six months since Taylor died and her case gained national attention. 

Mattingly, who was shot during the raid, and Cosgrove have been on administrative reassignment since March. Hankison, meanwhile, was fired in June after the interim police chief determined the evidence showed he fired indiscriminately into Taylor’s apartment.

Mattingly and Cosgrove, as well as four other LMPD officers, still face an internal investigation for possible violations of department policy in the Taylor shooting that could potentially cost them their job.

Taylor, a 26-year-old ER technician, was killed after officers used a “no-knock” search warrant at her apartment shortly before 1 a.m. on March 13, looking for drugs and cash as part of a larger narcotics investigation connected to her former boyfriend.

When the door burst open, Taylor’s boyfriend, Kenneth Walker, fired a single shot from his Glock handgun. Police said that round hit Mattingly in the thigh, severing an artery.

Mattingly, Cosgrove and Hankison fired more than two dozen rounds in response, spraying the apartment and hitting Taylor six times. Taylor, who was unarmed, died in her hallway.

Walker has since filed a lawsuit against the department, arguing he is a victim of police misconduct and seeking immunity from prosecution.

Cameron’s office obtained the police department’s Public Integrity Unit investigation into the officers’ conduct on May 20. The duration of the investigation prompted questions from public officials and impatience from onlookers demanding justice for Taylor.  

The FBI is also investigating Taylor’s death.

New York’s attorney general has said a grand jury will be formed to investigate the death of Daniel Prude, an unarmed black man who suffocated after being restrained by police.

Mr Prude – who suffered from mental health issues – died after officers put him in a “spit hood”, designed to protect police from detainees’ saliva.

Protests have been held after footage of the incident in Rochester emerged.

Seven police officers have been suspended.

The 41-year-old died in March however his death has only just been reported.

Attorney General Letitia James said in a statement: “The Prude family and the Rochester community have been through great pain and anguish. My office will immediately move to empanel a grand jury as part of our exhaustive investigation into this matter.”

The move has been welcomed by Rochester Mayor Lovely Warren and New York Governor Andrew Cuomo. But a spokeswoman for the Rochester Police Department declined to comment.

Mr Prude’s brother, Joe, told the New York Times: “I am ecstatic about this. But right now I’m still waiting on seeing the indictment and them being prosecuted to the full extent of the law.”

What happened to Daniel Prude?

Joe said he called police on 23 March as Daniel was showing acute mental health problems. When officers arrived, he had been running naked through the streets.

In body camera footage obtained from the police by Mr Prude’s family, he can be seen lying on the ground as officers restrain him. While sitting on the road, he becomes agitated, alternately asking for money or a gun.

He began spitting on the street, but does not appear to offer any physical resistance, according to the footage. An officer says that Mr Prude told them he had Covid-19, and they place the spit hood on him.

One officer can be seen pressing down on Mr Prude’s head with both hands, saying “stop spitting”. Mr Prude stops moving and goes quiet, and officers note he feels cold.

Paramedics are called and Mr Prude is taken to hospital. His family took him off life support a week later.

The medical examiner ruled his death as a homicide caused by “complications of asphyxia in the setting of physical restraint”, with intoxication by the drug PCP, a contributing factor.

Mayor Warren said the city police chief had failed to inform her of the case until the beginning of last month.

But police chief La’Ron Singletary denied that his department had been trying to keep the details out of public view, and Michael Mazzaeo, president of the Rochester Police Locust Club, said the officers had followed their training “step by step”.

The officers were only disciplined after the footage was released, five months after Mr Prude’s death. Protests in the city have taken place nightly since the release of the footage.

Mr Prude’s death came two months before that of George Floyd, whose killing while in police custody sparked widespread outrage and incited national and international demonstrations against police brutality and racism.

As coronavirus cases increase in Michigan, state health leaders have downgraded several state regions on a coronavirus “risk phase” map.

The Grand Rapids region was moved to “high risk,” joining the Lansing region. The metro Detroit area also dropped one grade to “medium high” risk and regions in the northern Lower Peninsula and Upper Peninsula moved to “medium risk.”

The state maintains the MI Safe Start Map as a way to gauge the control of coronavirus in various areas of the state.

The map does not affect any region’s status under Gov. Gretchen Whitmer’s economic reopening plan and most of the Lower Peninsula remains at level four.

According to the map, as updated July 4, the Grand Rapids region has dropped two phases since June 25 when it was in the “medium risk” phase.

State health leaders say the region has experienced three weeks of COVID-19 case increases.

Kent County Health Director Adam London, in a video posted to the health department Facebook page Wednesday, July 8, said the daily new coronavirus cases are now averaging about 50, which is about double what it was two weeks ago.

He called the increase “concerning.”

“I think it’s important for us to know that right now we are in a precarious position. We are seeing cases increase and we know that we are very vulnerable for a resurgence in cases,” he said.

He also said the county’s rate of positive cases, compared against all coronavirus tests administered, is about 3.7 percent. The rate is above the state’s 2 percent goal.

According to the state map, the nine-county Detroit region was moved one risk level lower “based on case rate and percent positivity increases over three weeks.”

The Traverse City region and Upper Peninsula shifted from the “low risk” phase to the “medium risk” phase because both have “seen increased case rates and testing positivity.”

The Lansing region remained in the “high risk” phase. The region was moved to that level in late June after a spike in coronavirus cases largely related to attendance at an East Lansing bar in mid-June.

COVID-19 PREVENTION TIPS

In addition to washing hands regularly and not touching your face, officials recommend practicing social distancing, assuming anyone may be carrying the virus.

Health officials say you should be staying at least 6 feet away from others and working from home, if possible.

Use disinfecting wipes or disinfecting spray cleaners on frequently-touched surfaces in your home (door handles, faucets, countertops) and carry hand sanitizer with you when you go into places like stores.

Michigan Gov. Gretchen Whitmer has also issued an executive order requiring people to wear face coverings over their mouth and nose while inside enclosed, public spaces.

An Arizona woman hiking off trail at Mather Point in Grand Canyon National Park was trying to take photos when she fell to her death, the park says.

Maria A. Salgado Lopez, 59, of Scottsdale, was hiking Friday afternoon when she accidentally fell off the edge of Mather Point, the park said in a press release.

Park rangers responded and found her body about 100 feet below the point’s rim.

“An investigation into the incident is being conducted by the National Park Service and the Coconino County Medical Examiner’s Office,” the release stated.

The park reminded visitors during the Fourth of July weekend of safety guidelines.

“Grand Canyon National Park staff encourage all visitors to have a safe visit this holiday weekend by staying on designated trails and walkways, always keeping a safe distance from the edge of the rim, and staying behind railings and fences at overlooks,” the park said.

A Georgia prosecutor on Wednesday said three white men charged in the death of Ahmaud Arbery, a black man who was shot dead while running in a residential neighborhood in February, have been indicted by a grand jury on murder charges.

The three men — Travis McMichael, Gregory McMichael and William R. “Roddie” Bryan — each were indicted on nine counts: malice murder, four counts of felony murder, two counts of aggravated assault, false imprisonment and criminal attempt to commit false imprisonment.

If convicted on the murder charges, the defendants would face a minimum of life in prison and could face a death sentence.

“This is another step forward in seeking justice for Ahmaud,” said Joyette M. Holmes, the district attorney in Cobb County, who was specially appointed to handle the case. “We will continue to be intentional in the pursuit of justice for this family and the community at large as the prosecution of this case continues.”

Outside the Glynn County Courthouse, Holmes said the grand jury had taken only 10 minutes on Wednesday to formalize the charges. “The family was ecstatic to hear that it had happened this morning,” Holmes said.

The announcement suggested that the case against the three men is moving forward swiftly after criminal justice advocates objected to what they saw as a long initial delay in seeking charges.

“This confirms what Ahmaud’s father has been saying for months — that this was a lynching,” Arbery family attorney Ben Crump said in a statement. “This is a significant step on the road to justice and while nothing will bring back Ahmaud’s life, it is important that a Grand jury recognized his life had value and was wrongly and ruthlessly ended.”

Arbery was killed on Feb. 23 after the men followed him through a neighborhood after he jogged by. Arbery was fatally shot after the men confronted him, but no charges were filed in the immediate aftermath. It was not until video surfaced of the killing that pressure grew on prosecutors, and charges against Gregory and Travis McMichael — father and son — were announced in May. Bryan, who filmed the killing, was charged later.

The grand jury indictment means that jurors found probable cause to send the case to trial.

Bob Rubin, an attorney for Travis McMichael, said in an email to the Associated Press that his client intended to plead not guilty and that “we look forward to presenting all of the facts regarding this tragic death in a court of law.”

Kevin Gough, Bryan’s attorney, told reporters that the indictment was “an important step in the process to moving this case closer to the speedy trial that Roddie has demanded.” Gough said Bryan, 50, was a witness to the killing, not an accomplice. An attorney for Gregory McMichael has said his client is innocent and plans to fight the charges in court.

Arbery, who was 25, was shot dead by Travis McMichael, 34, as he ran through a residential area of coastal Brunswick, Ga. Before charges were filed, Arbery’s mother contended that the case had been “mishandled from the very beginning.”

The killing sent shock waves through the community. But it was not until cellphone video was leaked online in May that the case began receiving national attention. It contributed to the widespread sense of racial injustice that swept the country this spring, culminating with protests following the Memorial Day death of George Floyd at the hands of police in Minneapolis.

The father and son tracked Arbery down in their pickup and blocked his repeated attempts at escape, video shows. Prosecutors say Bryan assisted the chase in a separate vehicle. With Arbery cornered, Travis McMichael got out of the truck and fatally shot Arbery following a brief scuffle, according to the video and authorities.

In May, Holmes became the fourth prosecutor to handle the investigation of Arbery’s killing, after she was appointed by Georgia’s attorney general. The first two prosecutors who reviewed the investigation recused themselves because of previous work connections with Gregory McMichael, and the third, Thomas Durden of the Atlantic Judicial Circuit, requested that the case go to someone else, according to a statement from Attorney General Chris Carr (R).

At a preliminary hearing earlier this month, attorneys for the McMichaels argued that their clients had acted lawfully in their pursuit of Arbery and that Travis McMichael had fired at Arbery in self-defense. But Richard Dial, with the Georgia Bureau of Investigation, testified that it was Arbery who had acted in self-defense.

In his testimony, Dial also said that Bryan told investigators after the incident that the younger McMichael uttered a racial slur as Arbery lay dying in the road.

A Georgia prosecutor on Tuesday recommended that a grand jury review the fatal shooting of a black man while he was out jogging earlier this year.

The investigation into the killing of 25-year-old Ahmaud Arbery on Feb. 23 has been criticized by many in the state. Now, a disturbing video that emerged online on Tuesday purports to show key parts of the incident and has increased calls for charges.

Joe Biden, the presumptive Democratic presidential nominee, took to Twitter to write that the video is “clear” and Arbery “was killed in cold blood.” He wrote that his heart goes out to Arbery’s family and called for a transparent investigation into the “murder.”

A black man can be seen in the video running at a slow pace toward a white truck that is stopped in the middle of a country road. Two men are seen outside the vehicle, including one standing on the truck’s bed. The black man seems to attempt to run around the truck, and the moment he clears the vehicle, a shot rings out.

A brief struggle ensues in what looks like an effort to control a shotgun, and another two shots are heard, according to the video. The runner staggers away and collapses.

The man in the truck’s bed is seen holding a handgun after he climbs out to approach the others.

Tom Durden, the district attorney pro tempore for the Brunswick Judicial Circuit, called for a grand jury review of the case stemming from the shooting in Brunswick, New4Jax.com of Jacksonville, Fla., reported.

Durden told The Associated Press that no arrests have been made. He declined to say what charges he would have a grand jury consider. He declined to comment Tuesday when the prosecutor was asked if he could verify that the video showed the shooting of Arbery.

The report said Travis McMichael, the son of a former district attorney investigator, fired the fatal shot. He was not immediately charged because he claimed that he was conducting a citizen’s arrest, the report said. There have been a string of burglaries in the area and Arbery supposedly fit the description of the suspect.

Lee Merritt, the attorney for Arbery’s family, told The Washington Post that family members watched the video of the shooting on Tuesday.

“Mr. Arbery had not committed any crime and there was no reason for these men to believe they had the right to stop him with weapons or to use deadly force in furtherance of their unlawful attempted  stop,” he told the paper.

The Post, citing a police report, said Arbery was spotted jogging by Gregory McMichael, the former investigator. News4Jax reported that the father called 911 at 1:08 p.m. to report a “black man running down the street.”

He reportedly told a dispatcher that he suspected Arbery was involved in recent burglaries.

The 64-year-old called his son and they armed themselves, according to the report. The police report says Gregory McMichael told officers he and his son first tried to stop Arbery by shouting, “Stop, stop, we want to talk to you!”

The father claimed that Arbery attacked his son and they got into a struggle for a shotgun. Police said the son fired two shots.

Georgia Gov. Brian Kemp tweeted Tuesday that the head of the Georgia Bureau of Investigation offered to assist in the investigation.
