As states struggle to keep the coronavirus out of nursing homes, employees who work at multiple facilities are thought to be behind some of the continuing spread.

WEST PALM BEACH, Fla. — In late May, Jean-Junior Vertu and Marie Julceus, two employees at a long-term care facility near West Palm Beach, Fla., took a routine test for the coronavirus and then went about their workday. They felt fine. Mr. Vertu, a dietary aide, pureed food for the residents while listening to Haitian dance music. Ms. Julceus, a nurse, helped them eat.

When their seven-hour shift ended, they went straight to their second seven-hour shifts, at different nursing homes.

Little did they know that, as they traveled several times that week from one facility to another, they had been taking the virus with them.

“When I got the message that said I was Covid positive, I got scared,” said Ms. Julceus, 50, who learned she had the virus at about the same time that Mr. Vertu did. “I took my temperature, I laid down and said, ‘Oh my God, oh my God.’”

Although it is often impossible to pinpoint exactly who spreads the virus and how, public health experts trying to understand the virus’s lightning surge through nursing homes have identified staff members working at multiple facilities as an important risk factor.

Florida, which has one of the country’s highest populations of older people, has for several months had a strict ban on visitations and prohibited hospitalized Covid-19 patients from returning to nursing homes until they had twice tested virus-free. Yet new outbreaks at the state’s nursing homes have continued to emerge, suggesting that staff members — especially those who travel from one facility to another — are the most likely explanation.

At Oasis Health and Rehabilitation Center in Palm Beach County, where Ms. Julceus worked nights, there have been 17 deaths and 73 cases among staff members and residents, infections whose origins have not been clearly identified. Recent research shows that the center is connected, via shared staff, to 25 other “high-risk” facilities that have also had outbreaks whose origins may be staff-related.

Health policy analysts say that poorly paid staff members working two or more nursing home jobs may be significant contributors — usually unwittingly — to the spread of the virus. Several nursing home employees in Florida have been terminated after being accused of coming to work sick.

“Unfortunately, staff have been the largest vector towards bringing Covid into nursing homes around the country,” David Grabowski, a professor of health care policy at Harvard Medical School, said.

“I don’t know that there’s a lot of other pathways in,” he said. “Florida is pretty closed down, and yet they’ve seen a rise in cases.”

Across the United States, more than 62,000 nursing home residents and staff members have died from Covid-19, about 40 percent of the nation’s coronavirus fatalities. Florida has counted 4,232 deaths at long-term care facilities, according to state data, with such facilities accounting for more than half of all Covid-19 deaths in June. Then in July, over a three-week period, the number of residents testing positive doubled.

A recent report by the National Bureau of Economic Research that looked at geolocation data found that 7 percent of smartphones appearing in a U.S. nursing home also appeared in at least one other elder facility, even after visits by patients’ friends and family members were restricted.

The typical nursing home has, on average, staff connections with 15 other facilities, said the report, which concluded that “eliminating staff linkages between nursing homes” could reduce coronavirus infections in nursing homes by 44 percent.

In Florida, the researchers found a web of interconnected nursing homes and assisted living facilities, particularly in Miami-Dade County, which has one of the highest concentrations of them in the country.

Oasis Health and Rehabilitation Center, where Ms. Julceus worked, has staff members who work at 25 other facilities, including one home that has employee connections to another 56. Golden Glades, which had an outbreak in May, is connected to 40 other facilities, many of which also had sizable outbreaks.

A lockdown on visitations and transfers of known coronavirus patients, in place after March, was initially thought to be the silver bullet that would clamp down on new nursing home infections.

“What our research is suggesting is that the real culprit here, epidemiologically, appears to be shared staff,” said Keith Chen, professor of behavioral economics at the U.C.L.A. Anderson School of Management and a lead author of the report.

Nursing homes generally struggle with finding enough staff and, faced with laws that require a certain number of staff hours per resident, “there’s a tremendous number of staffing agencies that spring up to spread workers across nursing homes,” he said.

“But that’s exactly what you don’t want in the middle of a respiratory pandemic,” he added.

Employees working at more than one facility are thought to have contributed to the country’s first coronavirus outbreak in a nursing home in Kirkland, Wash., according to the Centers for Disease Control and Prevention.

“Limitations in effective infection control and prevention and staff members working in multiple facilities contributed to intra- and interfacility spread,” the agency said at the time.

Life Care Centers of America, which operates about 200 facilities nationwide, including the Kirkland facility in Washington and 21 nursing homes in Florida, stopped using contract workers after the pandemic began, Davis Lundy, a spokesman for the company, said. Employees now work in only one building, he added.

One temporary staffing agency in Florida, Interim HealthCare, said it contracts employees to three nursing homes in the Miami area, all of which have had outbreaks. Krystal Bay Nursing and Rehabilitation Center reported seven deaths and at least 39 cases among staff and residents; West Gables Health Care Center, 10 deaths and 88 cases; and Seasons Gardens, no deaths but 36 cases.

Daniel Kern, a manager at Interim HealthCare, said he knew of about eight workers from his agency who had tested positive. All of them presumably would have worked at the affected facilities. But he said he was confident they did not transfer the virus because the agency provided its employees with ample personal protective equipment.

Officials at the nursing homes declined to discuss the matter. The Florida Department of Health, which has required nursing homes to test their staff members every two weeks, declined to discuss the role of staff members in the spread of the virus and did not make state nursing home inspectors available for interviews.

Steve Bahmer, the chief executive of LeadingAge Florida, a trade body for nursing homes, said the risk of staff-spread infections exists even without employees who work at multiple facilities.

“If there is significant community spread, staff are at risk of contracting the virus and bringing it into the nursing home or assisted living facility,” he said.

Nursing home experts say that spread of the disease can be exacerbated by low pay scales that force nurses and aides to seek work at more than one facility.

“We don’t value this work force, and if we paid them a full-time position or a living wage, they wouldn’t have to do all this moonlighting across facilities,” Dr. Grabowski of Harvard said.

Many staff members are not employed full time even though they essentially do two full-time jobs a day, sometimes 14-hour-long stretches separated by a break of just one or two hours. Most get paid close to minimum wage and do not get sick leave.

Mr. Vertu, 33, the dietary aide, said he gets paid about $9.80 an hour, a salary he says has remained roughly unchanged since he started working 14 years ago. Ms. Julceus, who is a certified nurse, earns about $12 an hour.

Sheryl Carlos, 56, works three jobs seven days a week in Port St. Lucie, north of West Palm Beach. One is at a nursing home and another at a retirement community; she earns extra income caring for a couple of people in private homes. She makes about $13 an hour.

“Let me tell you something, I don’t have a life,” she said recently as she drove back home in the early morning after finishing a nine-hour shift. “If some jobs were paying you enough, you wouldn’t have to be working like that.”

Nursing home advocates say that most facilities have little control over what other jobs staff have. It is hard to raise wages, they say, when revenue is fixed by the state or Medicare.

“There are really good owners out there who do a good job and try to pay people more,” said Dr. Alice Bonner, who advises on care of older adults at the Institute for Healthcare Improvement.

“But if you’re getting mostly Medicaid clients in your nursing home, and you’re getting very little money for those clients, and it’s not covering your costs, then it’s really hard to increase salaries and benefits too.”

In May and early June, one of Mr. Vertu and Ms. Julceus’s employers, Avante at Lake Worth Rehabilitation and Skilled Nursing, fired them on the grounds that they had violated policy by coming to work even though they had the coronavirus, according to the employees and their union, which has filed grievances over the dismissals.

Both had been tested at their other jobs, and had continued working while they waited for their results. They insist they had no way of knowing they were sick; they had no symptoms, and their tests, taken at other workplaces, had not come back yet.

“I didn’t bring in the virus,” said Mr. Vertu, who had worked at the facility since 2006. “They call me a criminal. It’s terrible.”

John Hornack, general counsel at Avante Group, said the company could not comment because a union grievance was pending on behalf of the two employees.

Some of those working at multiple nursing homes said they felt that the residents needed them during the pandemic more than ever.

Margalie Williams, 62, a certified nurse in Miami, has survived breast cancer, three strokes and, most recently, the coronavirus.

Ms. Williams said she believed she contracted the coronavirus in early March, after an 80-year-old resident she took care of at Golden Glades developed a high fever.

She was sent to the hospital, where she got tested, and came back. As she waited to receive her results, Ms. Williams continued treating her, and after her shift at Golden Glades was over, she went to her next job at Miami Shores.

Soon, Ms. Williams started feeling unwell too. When she got tested a few days later, the result came back positive.

Her recovery took nearly five months, but now she is back at her two nursing home jobs. The residents need her, she said.

“If they don’t see you one day they tell you, ‘Oh Maggie, I miss you,’” she said. “You can’t leave them.”

Former Vice President Joe Biden has mostly responded to the aftermath of George Floyd’s death by contrasting his governing and leadership style with President Trump’s. But the presumptive Democratic presidential nominee has also laced his speeches, interviews and campaign statements with policy specifics.

Biden has called for a federal ban on police chokeholds, a new federal police oversight commission, new national standards for when and how police use force, more mandatory data collection from local law enforcement, and more power for the Department of Justice to investigate local police departments, among other changes.

“Let us vow to make this, at last, an era of action to reverse systemic racism with long overdue and concrete changes,” Biden said in a speech last week.

And while Biden has rejected progressive demands for something that Trump is eager to tie his fall opponent to — “defunding” police departments — Biden has said that federal funding for law enforcement should be “based on whether or not they meet certain basic standards of decency and honorableness.”

Two members of a task force charged with pulling Biden’s campaign platform to the left are encouraged by Biden’s initial statements and demands, but remain hopeful the onetime author of tough-on-crime bills will embrace even broader policing and criminal justice reforms.

“I’m encouraged that he’s getting specific and trying to meet the moment,” said Chiraag Bains, who worked in the Department of Justice’s Civil Rights Division during the Obama administration. Vermont Sen. Bernie Sanders tapped Bains to co-chair the criminal justice reform committee the Sanders and Biden campaigns set up at the end of their primary contest as part of a broader effort to try to reach more policy consensus between the progressive and moderate wings of the Democratic Party.

“It’s not enough to speak to people’s pain and utter the right words,” said Bains, who emphasized he was speaking for himself, not the task force.

Bains said Biden’s statements and speeches have been the right start, and have been well-received — especially when contrasted to the president. “But we need a specific agenda and it needs to be bold,” he said. ” I do see that the vice president moving that direction. I just think we need to do more.”

Bains wants Biden to expand on already-announced proposals on ending mandatory minimum prison sentences and ramping up the use of clemency. He’s also pushing for the restoration of federal parole and the legalization of marijuana, among other policies.

Progressives see this moment of national protests and calls to action — a moment where even a former Republican presidential nominee is marching and declaring that “black lives matter” — as a once-in-a-generation chance for substantial reforms.

Stacey Walker, a fellow Sanders appointee to the criminal justice task force and chairman of Iowa’s Linn County Board of Supervisors, called the worldwide protests against police violence and racism “a global liberation movement” that could open the door for massive policy changes.

“I think the vice president totally understands that we are at a moral moment in history,” Walker said. “The policies that he is supporting certainly is a step in the right direction, and it’s going to help move the dialogue along on the issues we seek to address. Now, there are a lot of advocates in the criminal justice reform space who believe that we can do more, who believe that this is a moment, unlike any other, in the fight for freedom for black Americans in this country.”

Led By Tim Scott, Senate Republicans Begin Drafting Their Own Police Reform Plan

The task force, divided between Sanders and Biden appointees, meets online once a week, with constant smaller phone calls and emails between members in between sessions. Along with the other committees working on climate change and other policy areas, it aims to present proposals ahead of August’s Democratic National Convention.

One example of the push and pull between Biden’s instincts and those of the progressives who flocked to Sanders, and would need to back Biden in order for him to win this fall: how to lessen federal marijuana penalties. Biden has called for decriminalizing marijuana. Bains is hoping Biden shifts to a call for full legalization.

“Decriminalization typically means that you don’t have a criminal penalty, but you could still be issued a civil fine. And then there are other kinds of consequences that could follow from that,” Bains explained. “It’s still illegal conduct. If possession of marijuana is just decriminalized and that is the hook for extensive police involvement in people’s lives. And if you haven’t addressed the underlying systemic problems in policing and the justice system overall, then people could continue to be stopped and searched and frisked and so forth.”

Still, a call for decriminalizing — if not fully legalizing — marijuana marks a notable shift for Biden, who as a senator authored and voted for several tough-on-crime measures in the 1980s and 1990s that strengthened penalties for drug-related crimes in particular.

The most high-profile measure: the 1994 crime bill, which Biden helped write as a senator. While Biden regularly highlights the legislation’s domestic violence protections and 10-year ban on assault weapon sales, the measure is more broadly seen as a key moment in a generation-long policy push that led to increasingly crowded prisons, and that disproportionately targeted African-Americans.

“We now know with the fullness of time that we made some terrible mistakes,” Jeremy Travis, the president of the John Jay College of Criminal Justice, told NPR in 2014.

“Here’s the federal government coming in and saying we’ll give you money if you punish people more severely, and 28 states and the District of Columbia followed the money and enacted stricter sentencing laws for violent offenses,” Travis said.

When Biden’s campaign rolled out his criminal justice policy platform last year, a key provision proposed just the opposite. Biden wants to fund a $20 billion grant program aimed at lowering incarceration and crime rates in states. “In order to receive this funding, states will have to eliminate mandatory minimums for non-violent crimes, institute earned credit programs, and take other steps to reduce incarceration rates without impacting public safety,” the campaign’s policy paper reads.

But despite Biden’s shifts, some progressives still view him with skepticism on criminal justice, and have watched warily as Biden promises to take on policing abuses amid an unprecedented national focus on police violence and racism.

“This is an opportunity for him to come to account for his role in promoting the crime bill back in the ’90s that led to a lot of federal support of local police departments, federal arming of police departments and a lot more expectations and money that goes toward them,” progressive organizer Aimee Allison told NPR’s Morning Edition.

Allison is particularly frustrated at how quickly Biden rejected calls for “defunding” police departments.

“We understand the phrase ‘defund the police’ to be shorthand for a range of serious policy proposals that will end the cycle of police violence against black people and put public safety before violence,” Allison said. “But if Joe Biden is not serious about ending that cycle, he’s risking the success of his campaign. I mean, this is the make-or-break moment for him.”

Stacey Walker supports police defunding, too, though he conceded “we may have a marketing and branding issue on our hands” when it comes to selling non-progressives on the idea of shifting government resources away from law enforcement, and toward social services, education, and other areas.

Walker doesn’t see Biden shifting ground on the issue. But ultimately, he doesn’t think that will hurt Biden with the progressives who have embraced the push.

“We all understand that Donald Trump poses an existential risk to our democracy, to the American project and to everything Democrats hold dear,” Walker said. “So while you know, we’re not going to get to a point where everyone is happy, although that is the goal. I think Democrats are going to be united.”

A document by prosecutors details how Mr. Chauvin, a former Minneapolis police officer, interacted with George Floyd before his death. Third-degree murder does not require an intent to kill.

The former Minneapolis police officer charged in the death of George Floyd held his knee to Mr. Floyd’s neck for nearly nine minutes, including for two minutes and 53 seconds after Mr. Floyd became unresponsive, according to a document released by prosecutors on Friday.

The document, a statement of probable cause, was used to support a third-degree murder and second-degree manslaughter charges against the former officer, Derek Chauvin. The charges carry a combined maximum sentence of 35 years in prison.

The probable cause statement also said that preliminary results from an autopsy “revealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation,” adding that Mr. Floyd had coronary artery disease and hypertensive heart disease. “The combined effects of Mr. Floyd being restrained by the police, his underlying health conditions and any potential intoxicants in his system likely contributed to his death,” the statement said.

Mr. Floyd’s family released a statement on Friday saying the charges did not go far enough: “We expected a first-degree murder charge. We want a first-degree murder charge.”

A first- or second-degree charge would require prosecutors to prove that Mr. Chauvin intended to kill Mr. Floyd, said Richard Frase, a professor of criminal law at the University of Minnesota. He said the criminal complaint against Mr. Chauvin did not identify any specific motive for officers to kill Mr. Floyd, which essentially ruled out stronger murder charges.

Third-degree murder does not require an intent to kill, according to the Minnesota statute, only that the perpetrator caused someone’s death in a dangerous act “without regard for human life.” Second-degree manslaughter requires prosecutors to prove that Mr. Chauvin was so negligent as to create an “unreasonable risk,” and consciously took the chance that his actions would cause Mr. Floyd to be severely harmed or die.

Professor Frase said the case against Mr. Chauvin appeared to be even stronger than the one brought against Mr. Noor, who was convicted of third-degree murder and second-degree manslaughter.

In that case, Professor Frase said, the officer had seemingly panicked and fired a single shot. “There’s a question of whether he even had time to be reckless,” he said, referring to Mr. Noor. “Here, there’s eight minutes.”

The statement, which was written by Michelle M. Frascone, a special agent of the Minnesota Bureau of Criminal Apprehension, also describes how officers, including Mr. Chauvin, had come in contact with Mr. Floyd on Monday evening after responding to a report of someone trying to make a purchase at a store with a fake $20 bill.

Two officers approached Mr. Floyd, a former high school sports star who worked as a bouncer at a restaurant in Minneapolis, as he sat in a car not far from the store, the probable cause statement said. Mr. Floyd, who was in a car with two other people, was ordered out and arrested. But when the officers began to move him toward a squad car, he “stiffened up, fell to the ground, and told the officers he was claustrophobic,” the statement issued by prosecutors said.

When two other officers arrived, including Mr. Chauvin, the officers “made several attempts to get Mr. Floyd in the back seat” of a squad car, while Mr. Floyd “struggled with the officers by intentionally falling down, saying he was not going in the car, and refusing to stand still,” the statement said.

While still standing, Mr. Floyd began to say he could not breathe, the document said.

Around 8:19 p.m., Mr. Chauvin placed his knee onto Mr. Floyd’s neck area, holding him on the ground while another officer held his legs. At times, Mr. Floyd pleaded, saying, “I can’t breathe,” “please” and “mama.”

“You are talking fine,” the officers said as Mr. Floyd moved back and forth on the ground, according to the probable cause statement.

At 8:24 p.m., Mr. Floyd grew still, the statement said. A minute later, one of the other officers checked his wrist for a pulse but could not find one. Mr. Chauvin continued to hold his knee down on Mr. Floyd’s neck until 8:27, according to the statement.

Attorney General Bill Barr said Monday he does not expect U.S. Attorney John Durham’s review into the origins of the Russia probe will lead to a “criminal investigation” of either former President Barack Obama or former Vice President Joe Biden — while noting that their concern of “potential criminality” in the conduct of that probe is “focused on others.”

Barr, during a press conference otherwise focused on the December 2019 shooting at Naval Air Station Pensacola, spoke at length about the Durham investigation. He said he has a “general idea” of how the investigation is going and confirmed that “some aspects are being investigated as potential crimes.”

TRUMP WEIGHS IN ON UNMASKING

Barr did say, however, that “not every abuse of power, no matter how outrageous, is necessarily a federal crime.”

“As for President Obama and Vice President Biden, whatever their level of involvement based on what I know, I don’t expect Durham’s work will lead to a criminal investigation of either man,” Barr said. “Our concern of potential criminality is focused on others.”

This comes after both Obama and Biden — the presumptive Democratic presidential nominee — have faced heightened criticism from Republicans for any potential role in the early stages of the probe. Trump last week even called for Obama to be summoned to testify before Congress.

The politically explosive environment — bringing the country into uncharted territory, with a former president accused by critics of involvement in a political probe related to his eventual successor, and the sitting president now essentially calling for retribution against his predecessor — has built ever since the DOJ moved to dismiss its case against Michael Flynn.

LIST OF OFFICIALS WHO SOUGHT TO ‘UNMASK’ FLYNN RELEASED: BIDEN, COMEY, OBAMA CHIEF OF STAFF AMONG THEM

Barr and the DOJ cited problems with the FBI’s interview with the Trump national security adviser in deciding to back away from the prosecution on the charge of lying to investigators. New documents, meanwhile, indicated Obama was at least aware of the details of Flynn’s intercepted December 2016 phone calls with then-Russian Ambassador Sergey Kislyak, that were a subject of that fateful interview. Then, a list was released of Obama-era officials involved in seeking to “unmask” what turned out to be Flynn’s name in intelligence reports.

Both Biden and Obama’s chief of staff were among the officials involved in those requests.

Trump last week insisted Obama was involved in an unspecified “crime,” and continued to rail against the Obama administration in interviews.

But Senate Judiciary Committee Chairman Lindsey Graham was later reluctant to go along with Trump’s demand that Obama be called to testify.

“As to the Judiciary Committee, both presidents are welcome to come before the committee and share their concerns about each other. If nothing else it would make for great television. However, I have great doubts about whether it would be wise for the country,” he said in a statement last week.

Barr expressed similar reservations on Monday, making clear he’s concerned about potential wrongdoing during the Russia probe while also stressing that this process should not be a vehicle for retribution.

BRENNAN SAYS HE’S WILLING TO BE INTERVIEWED BY DURHAM, SAYS HE HAS ‘NOTHING TO HIDE’ 

He said “this will not be and cannot be a tit-for-tat exercise,” noting that “the only way to break away from a dual system of justice” is to “ensure we scrupulously apply” the same system to both sides of the aisle.

Barr maintained that “in the past few decades, there have been increasing attempts to use the criminal justice system as a political weapon,” using “the flimsiest of legal theories.” Barr said that is “not a good development. It is not good for our political life. It is not good for our criminal justice system.”

Barr said that, so long as he is attorney general “the criminal justice system will not be used for partisan, political ends.”

Barr said the nation is divided and it’s “critical that we have an election where the American people are allowed to make a decision—a choice—between President Trump and former Vice President Joe Biden based on a robust debate of policy issues.”

FLYNN BOMBSHELL PUTS RENEWED FOCUS ON DURHAM PROBE, SOURCE SAYS BARR TALKING TO HIM ‘EVERY DAY’ 

He added: “We cannot allow this process to be hijacked by efforts to drum up criminal investigations of either candidate.” Barr said that “any effort to pursue an investigation of either candidate has to be approved by me.”

He went on to make clear his dim view toward the Russia investigation that ended up targeting a number of Trump associates.

“What happened to the president in 2016 election and throughout the first two years of his administration was abhorrent,” Barr said, adding that “it was a grave injustice and it was unprecedented.”

“We saw two different standards of justice emerge. … One that applied to Trump and his associates, and another that applied to everyone else,” Barr said.

“The Durham investigation is trying to get to the bottom of what happened,” Barr continued, adding that it will “determine if there were any federal laws broken, and if there were, those who broke the laws will be held to account.”

TRUMP WEIGHS IN ON UNMASKING: ‘GREATEST POLITICAL CRIME IN THE HISTORY OF OUR COUNTRY’

Multiple sources have told Fox News that Durham is expected to wrap up his investigation by the end of the summer.

One source said that the “pattern of conduct” Durham is investigating includes misrepresentations made to the FISA court to obtain warrants to surveil Trump campaign associate Carter Page, as well as the “unmasking” of Flynn’s identity.

“Barr talks to Durham every day,” one source recently told Fox News. “The president has been briefed that the case is being pursued, and it’s serious.”
