]]>Adm. Brett Giroir, assistant secretary for health at the U.S. Department of Health and Human Services, said the United States is still in the middle of the coronavirus pandemic and that states seeing a resurgence in cases should think about imposing new lockdown orders.
“We are not out of this at all. We’re all very concerned,” Adm. Giroir said Sunday on ABC’s “This Week.”
He did say the percentage of tests coming back positive has started to level off a bit and that the U.S. is much better prepared in terms of protective equipment supplies compared to a few months ago.
But he said he expects hospitalizations and deaths to start going up in the coming weeks.
“If you have more cases, more hospitalizations, we do expect to see that over the next two or three weeks before this turns around,” he said. “It’s starting to turn now, but we won’t reap the benefits for a few weeks.”
He also said states like Florida, Arizona, and Texas that are seeing a new resurgence of cases to consider imposing new lockdowns to try to slow the spread.
“Everything should be on the table,” he said.
He said closing bars and limiting restaurant capacity are two key steps for states with high rates of transmission right now.
“This is not out of control, but it requires a lot of effort,” he said. “You really got to stop the bars. You have got to decrease restaurant capacity. You have got to physically distance.”
“We have to have people wearing a mask in public. It’s absolutely essential. And you have got to use good hand hygiene,” he said.
There are now more than 3.2 million positive cases and more than 134,000 coronavirus-related deaths in the U.S. among the country’s population of more than 300 million people.

LOUISVILLE, Ky. — Officer Brett Hankison has been fired, effective June 23, for his role in the shooting death of Breonna Taylor, Louisville Metro Police announced.
In a letter, interim Chief Robert Schroeder wrote that after Tuesday’s pretermination hearing, Schroeder decided to proceed and terminate Hankison.
Schroeder notes that Hankison may appeal the decision to the Police Merit Board in writing within 10 days.
A request for comment from David Leightty, an attorney for Hankison, was not immediately returned Tuesday evening.

“It’s another good, small step,” said Sam Aguiar, an attorney for Taylor’s family. “We won’t be satisfied until rightful charges are brought against him, until charges are brought against everyone responsible for Breonna’s death.”
A spokeswoman for LMPD declined to comment further, citing state law.
Taylor, a 26-year-old ER technician, was in her South End apartment when Louisville Metro police fatally shot her just before 1 a.m. March 13 while serving a search warrant as a part of a narcotics investigation.
Court records show that police obtained a warrant with a no-knock provision for Taylor’s apartment signed by Circuit Judge Mary Shaw.
Even so, officials have said that plain-clothes officers knocked and announced their presence before breaking in Taylor’s door with a battering ram.
Taylor’s boyfriend, Kenneth Walker, who was also in the apartment, fired one shot in response, hitting Sgt. Jonathan Mattingly in the thigh. Mattingly, Hankison and officer Myles Cosgrove all fired their weapons, killing Taylor.
Walker has said he fired because he thought intruders were breaking in. He and neighbors have said they never heard police announce themselves before entering, according to his attorney and lawyers for Taylor’s family.
Mattingly and Cosgrove remain on administrative reassignment.
No officers have been criminally charged in Taylor’s death.

Schroeder’s Tuesday letter to Hankison reiterated the allegations made against him in his pretermination letter Friday: Hankison showed “extreme indifference to the value of human life” and his use of deadly force was improper because he failed to verify it was directed against someone who posed an immediate threat.
Schroeder accuses Hankison of “blindly” firing 10 rounds into Taylor’s apartment and the one next door.
“I find your conduct a shock to the conscience,” Schroeder repeated. “I am alarmed and stunned you used deadly force in this fashion.”
Quoting from the Police Merit Board’s rules, Schroeder notes that any appeal from Hankison is due in writing within 10 days and “must include a statement of the grounds for appeal.”
The board will then schedule a public hearing to review the chief’s move to terminate Hankison, considering whether it was “unjustified or unsupported by proper evidence.” It will only consider evidence presented in the public hearing.
If it determines the action was unjustified, it can set aside the chief’s order and create a new penalty or opt to reinstate Hankison’s employment.
Mark Dobbins, an attorney for the merit board, said Friday that in many past cases, officers who have criminal matters pending will ask for the merit board proceeding to be held “in abeyance,” meaning delayed until the resolution of the criminal case.
That could mean that any hearing for Hankison could be scheduled after a decision on criminal charges is made by the state attorney general and U.S. Department of Justice, and until any future cases are resolved.

What is the Police Merit Board?
Per state law, the merit board has five members appointed by the mayor and approved by Metro Council, who serve four-year terms.
The board is tasked with reviewing police applicants and setting rules around promotions, qualifications and discipline for officers.
It also considers the chief’s disciplinary actions when officers appeal their suspension, termination or demotion.
In discipline cases, two police officers elected by LMPD to two-year terms serve as additional members of the board, with voting powers.
One of those two police officers, in recent years, has been Hankison himself.
The rules set out how board members who are appointed by the mayor can be removed “for neglect, incapacity, misfeasance or malfeasance.” It does not lay out how a police officer would be removed.

One of the requirements of serving, however, is that you are a police officer.
If a vacancy comes up during an officer’s two-year term on the merit board, a new election is supposed to be held within 60 days of the date of the vacancy.
Merit board rules say employees may be disciplined for “any cause which promotes the efficiency of the service.” That includes:
- Incompetency or inefficiency in job performance.
- Conduct unbecoming, either on- or off-duty.
- Violations of departmental rules, Metro-wide policies or laws.
- Behavior that threatened or injured the health and safety of the employee or of others.
- Absence without leave.
- Insubordination.
- Solicitation or acceptance of gift or remuneration outside of regular compensation.
An officer has the right to appeal the merit board’s decision within 30 days to circuit court.

The Hall of Fame quarterback said Kaepernick will receive “hero status” because he was willing to sacrifice his NFL career to protest racial inequality and social injustice. Favre compared him to the late Pat Tillman – the former Arizona Cardinals safety who left his football career to join the Army after Sept. 11.
“I can only think of right off the top of my head, Pat Tillman is another guy that did something similar,” Favre told TMZ Sports. “And, we regard him as a hero. So, I’d assume that hero status will be stamped with Kaepernick as well.”
Tillman, who was killed in Afghanistan in 2004 by friendly fire, played four seasons in the league after being a seventh-round pick in the 1998 NFL Draft. He then decided to give up his NFL career to fight for the United States.

In 2016, Kaepernick, who was in his sixth season with the San Francisco 49ers, began kneeling during the national anthem to protest police brutality and social injustice. After the season, he was released, and he has yet to sign another NFL contract. He filed a grievance in 2017 that the NFL and its owners were blackballing him to keep him out of the league.
“It’s not easy for a guy his age — black or white, Hispanic, whatever — to stop something that you’ve always dreamed of doing, and put it on hold, maybe forever, for something that you believe in,” Favre said.

In the aftermath of the death of George Floyd in Minneapolis, Kaepernick has surged back into the NFL spotlight once again. Last week, NFL Commissioner Roger Goodell said he encourages teams to sign Kaepernick. If given the opportunity, Favre believes Kaepernick could still play at a high level.
“I thought he was a dynamic player when he was playing in his prime,” Favre said. “He’s still young and hasn’t been hit in several years, so there’s no reason to think that he’s lost that much of a step.”

]]>The U.S. Navy on Friday upheld the firing of Capt. Brett E. Crozier, who was relieved of his command aboard the USS Theodore Roosevelt after a letter he wrote pleading for help for his coronavirus-stricken crew was leaked to the media.
The former commanding officer of the coronavirus-stricken aircraft carrier was more focused on the comfort of his crew than their safety, the chief of naval operations said.
Capt. Crozier was fired in April after a letter he wrote complaining about the conditions aboard his ship, warning that the situation on his vessel was dire and that sailors would likely die without a stronger response, was leaked to the press.
Navy Chief of Operations Michael Gilday, who briefed reporters at the Pentagon about the results of the two-month naval investigation, said the letter was not the reason for his decision to uphold the firing.
“We place a great amount of trust and confidence in our commanding officers and rely on them to manage risk, make decisions and to communicate openly and honestly with their chain of command — especially in a crisis,” Adm. Gilday said.
Capt. Crozier is now at a desk job in San Diego. He is not eligible for further command, Adm. Gilday said.
Rear Adm. Stuart Baker, commander of the carrier strike group and Capt. Crozier’s immediate superior, also was faulted for his role in the incident. Adm. Gilday said his promotion to two-star admiral has been put on hold.
Adm. Gilday said there seemed to be a “paralysis” in the command team aboard the ship. The moves effectively cut short the careers of both men.
“When obstacles arose, both failed to tackle the problem head-on and to take charge,” he said.
The Navy investigation found that Capt. Crozier mismanaged the initial outbreak on the ship. Some of his decisions may have added to the spread of the virus, Adm. Gilday said.
“They were slow egressing sailors off the ship. They failed to move sailors to available, safer environments quickly,” he said.
In a statement later Friday, Pentagon officials said Defense Secretary Mark Esper stands firmly behind the Navy’s decision.
“The secretary of the Navy briefed Secretary Esper earlier today on the findings of the investigation into the USS Theodore Roosevelt COVID response,” said Pentagon spokesman Jonathan Hoffman. “Secretary Esper believes the investigation to have been thorough and fair and supports the Navy’s decisions based on their findings. We are proud of the crew of the USS Theodore Roosevelt and am glad that they are back at sea in the western Pacific projecting American power.”
Navy officials said the coronavirus likely came aboard the ship during a scheduled visit to the port of Da Nang in Vietnam. But they have yet to identify a “Patient Zero.”
The three-star commander of the Navy’s 7th Fleet told Capt. Crozier to devise a plan to get the crew off the ship once it pulled into Guam. Adm. Gilday said he didn’t receive it until the day Capt. Crozier was relieved, about a week into the stop on the island.
“I was not impressed with the slow egress off the ship,” he said. “Both Adm. Baker and Capt. Crozier fell well short of what we expect of those in command.”
He was fired by former acting Navy Secretary Thomas Modly, who himself resigned days after flying to Guam and giving a profanity-laced speech to the crew aboard through the public address system, during which he lambasted their former commander.
When Capt. Crozier sent his emotional letter asking for help with the outbreak, discussions were already well underway between the Navy and local officials in Guam.
“When he hit ‘send’ on that email, six hours before, the governor of Guam had already agreed to allow us to use hotel rooms,” Adm. Gilday said. “He felt we weren’t moving fast enough but those wheels were already in motion.”
He said Navy officials in Guam had “moved mountains” to find safer spaces for the crew even before the hotels were pressed into service. But Capt. Crozier apparently wasn’t satisfied with their efforts, officials said.
“Although it wasn’t individual rooms, it was the best that we had,” Adm. Gilday said. “They were placed six feet apart and 72 square feet were allocated for each sailor.”
He said vacant housing and barracks on base also were ready to house the sailors.
“On the day that Crozier sent the email, there were 700 beds unfilled,” Adm. Gilday said.
About 1,200 sailors aboard the ship eventually tested positive for the coronavirus.
Adm. Gilday also faulted Capt. Crozier for a decision to release sailors from quarantine in the rear section of the ship.
“It put his crew at higher risk and may have increased the spread of the virus,” he said.
After an initial investigation, Adm. Gilday said he thought Capt. Crozier should be reinstated to his command. But that changed after the more complete inquiry.
“Had I known then what I know today, I would not have made that recommendation to reinstate Capt. Crozier,” he said. “Moreover, if Capt. Crozier was still in command today, I would be relieving him.”
The USS Theodore Roosevelt returned to sea last month under the command of its new captain.

LOUISVILLE, Ky. — Mayor Greg Fischer announced Friday that Louisville Metro Police is initiating termination of Officer Brett Hankison, one of three LMPD officers to fire weapons on March 13 at Breonna Taylor’s apartment, killing her.
Hankison is accused by the department’s interim chief, Robert Schroeder, of “blindly” firing 10 rounds into Taylor’s apartment, creating a substantial danger of death and serious injury.
“I find your conduct a shock to the conscience,” Schroeder wrote in a Friday letter to Hankison laying out the charges against him. “I am alarmed and stunned you used deadly force in this fashion.”
“The result of your action seriously impedes the Department’s goal of providing the citizens of our city with the most professional law enforcement agency possible. I cannot tolerate this type of conduct by any member of the Louisville Metro Police Department,” he added. “Your conduct demands your termination.”
Specifically, Hankison is accused of violating departmental policies on obedience to rules and regulations and use of deadly force. Schroeder, who wrote that he received the investigation on Tuesday evening, notes Hankison was previously disciplined for reckless conduct and was disciplined in early 2019.
The other two officers who fired their weapons at Taylor’s apartment — Sgt. Jonathan Mattingly and Officer Myles Cosgrove — remain on administrative reassignment.

Fischer, in a Friday news conference announcing the Hankison’s termination, declined further comment.
“Unfortunately, due to a provision in state law that I would very much like to see changed, both the chief and I are precluded from talking about what brought us to this moment or even the timing of this decision,” Fischer said.
Attorneys representing Hankison in a civil lawsuit and the LMPD investigation looking into his conduct did not immediately respond to Courier Journal requests for comment on Friday.
Ryan Nichols, the president of the River City Fraternal Order of Police chapter representing Louisville Metro Police officers, declined to comment at this time.
Sam Aguiar, a Louisville-based attorney for Taylor’s family, said Friday about Hankison’s firing: “It’s about damn time.”
Hankison in recent weeks also has been accused of sexual assault by multiple women in viral social media posts. The allegations are similar, saying that he offered intoxicated women a ride home from bars before sexually assaulting them.
Aguiar told The Courier Journal on Friday that Hankison should have been let go “from Day 1.”
“Maybe, finally, the mayor realized that sometimes you just need to do what the best thing is for the city, and since Day 1, the best thing to do for the city (has been) to take this dirty cop off the payroll and off the streets,” he said.
In a court filing last week, Aguiar alleged that Hankison “could not be located” after the shooting took place.
The document also alleges that Hankison “fired more than 20 shots, the majority of which were fired blindly from outside the home through windows which were covered by shades and blinds.”
Photos of Taylor’s apartment provided by Aguiar show the sliding glass patio door boarded up from the outside. But inside, shards of glass can be seen on the apartment’s carpeted floor, and bullet holes riddle the curtains.
Aguiar said that “following the initial flurry of gunshots, witnesses state that an officer (presumably Hankison) yelled ‘reload’ and then proceeded to fire more into Breonna’s home. Several of Hankison’s rounds went into an adjacent apartment in which a pregnant mother and 5-year-old son were located.”
“There are legitimate concerns regarding LMPD’s propensity to cover up incriminating evidence implicating criminal conduct of Hankison,” Aguiar said in the document.

All three officers were under internal investigation by Louisville Metro Police’s Public Integrity Unit. That investigation has been shared with the FBI and state attorney general, who are expected to conduct additional investigation.
Neither the FBI nor the Kentucky attorney general have announced any criminal charges.
Metro Councilman Brandon Coan, D-8th District, called Hankison’s firing “the first and most important employment decision (Fischer) could have made in this case and the aftermath.”

Louisville FBI officials were at Taylor’s apartment on Friday morning executing a search warrant as part of their independent investigation and taking a “fresh look” at the evidence.
Spokesman Tim Beam said the FBI will investigate “all aspects” of Taylor’s death, including interviewing witnesses who have and haven’t already spoken to Louisville Metro Police. They’ll also examine all physical evidence and video evidence to better understand what transpired, he said.
“Today’s action is part of the process,” Beam said.
Hankison has faced allegations of planting drugs, sexual misconduct
A transfer log from Hankison’s personnel file shows he worked in LMPD’s 6th Division before joining the Narcotics Unit in 2016. Former Police Chief Steve Conrad said Hankison joined the department in 2003.
Hankison has collected more than $150,530 in overtime pay since 2015, according to city records.
Salary data shows he regularly collected thousands on top of his base salary while working for the department’s Narcotics Unit. The job switch only slightly bumped his salary, but boosted his overtime by more than $20,000 — a jump that made his 2016 overtime the 23rd highest in LMPD.
The following year, in 2017, he collected $48,046.30 in overtime, nearly doubling his salary of $58,593.60. That overtime payment was the department’s 12th highest.
Besides the recently surfaced sexual assault allegations, Hankison has also been investigated at least twice by LMPD’s Public Integrity Unit for accusations involving sexual misconduct. Both cases found no wrongdoing.
In 2015, a probation and parole officer told investigators that a parolee had informed her that Hankison told her he wanted to “date her.” In an initial interview, the parolee said he had “come on to her” and said a ticket could be taken care of if she had sex with him.
She later retracted those statements. An investigator, in recommending the case be closed, said no evidence was found, and it was clear she was being “deceptive.”
In 2008, Hankison was accused of receiving oral sex in exchange for not arresting a woman with an outstanding warrant, but the woman denied it occurred.
She said she wasn’t arrested because she gave information on a drug dealer.
He is also being sued in federal court by a man named Kendrick Wilson, who alleges that the detective has repeatedly arrested and planted drugs on him as a part of a “vendetta.”
It also says that Wilson and Hankison have had various interactions outside of the arrests, “including over a relationship with the same woman.”

]]>The fired leader of a Navy warship now pierside in Guam and stricken with the coronavirus might get his old job back following a main examination by the vice chief of marine operations.
Senior Navy leadership will inform Defense Secretary Mark Esper on the results of their investigation into a coronavirus break out aboard the U.S.S. Theodore Roosevelt and issues over the crew’s health that resulted in the firing of the captain, the resignation of the Secretary of the Navy and a lot of it’s 5,000 sailors being placed in quarantine.
Mr. Esper will consult with Adm. Michael M. Gilday, the Chief of Naval Operations, to discuss the results of the questions which could choose whether Capt. Brett E. Crozier will be brought back to command, chief Pentagon spokesperson Jonathan Hoffman stated Friday.
” He’s usually inclined to support Navy leadership in their choice,” Mr. Hoffman told press reporters. “he’s going into this with an open mind.”
The New York City Times is reporting the questions will state Capt. Crozier need to be returned to command but that hasn’t been separately validated.
” We are continuing to focus on getting the Teddy Roosevelt’s team back to health and back out to sea,” Mr. Hoffman said.
On April 2, Capt. Crozier was fired already acting Navy secretary Thomas B. Modly after a letter he wrote advocating help for his coronavirus-stricken team was published in the San Francisco Chronicle. Top military leaders in the Pentagon recommended Mr. Modly to await the results of an investigation prior to getting rid of Capt. Crozier from command to no get.
Mobile phone video spread out around the world on social networks of him leaving the ship to the cheers of his team. In numerous quarters, Capt. Crozier was hailed as a hero going to sacrifice his own profession for his team’s sake. He remains in seclusion on Guam after contracting the coronavirus.
The video obviously triggered Mr. Modly to fly to Guam where he provided a short, profanity-laced speech to the team over the ship’s intercom – at one point, calling Capt. Crozier “silly” – prior to flying back to Washington, D.C. The outcry over the message quickly caused Mr. Modly’s resignation.
