Former Whitewater deputy independent counsel Sol Wisenberg told “Bill Hemmer Reports” <\/a>Tuesday that the Michael Flynn<\/a> case judge’s “highly unprecedented” move to\u00a0hire\u00a0a personal attorney<\/a>\u00a0could indicate that he’s\u00a0“in trouble.”<\/p>\n

U.S. District Court Judge Emmet\u00a0G. Sullivan’s decision\u00a0to retain\u00a0high-profile attorney Beth Wilkinson comes as the D.C. Circuit Court of Appeals reviews Sullivan’s order not to immediately grant\u00a0the\u00a0Justice Department’s<\/a>\u00a0request to dismiss its case against the former national security adviser.<\/p>\n

JUDGE IN FLYNN CASE HIRES LAWYER<\/a><\/strong><\/p>\n

The appeals court\u00a0directed Sullivan last week to respond to a writ of mandamus request by Flynn’s lawyers\u00a0by June 1, and invited the government to respond “in its discretion within the same 10-day period.”<\/p>\n

“I\u00a0think what\u00a0they’re [U.S. appeals court] saying, [is]\u00a0 ‘Judge, what are\u00a0you doing?\u00a0You better explain what you’re\u00a0doing,'” Wisenberg said.\u00a0“I interpret it as a flashing\u00a0neon sign …\u00a0a wake-up call to him\u00a0[to] explain what you’re about because\u00a0the moves he’s made have been\u00a0very, very unusual.”<\/p>\n

The added representation is a further twist to\u00a0what has become an abnormal case. Although Flynn pleaded guilty to misleading the FBI about his contacts with then-Russian ambassador Sergey Kislyak after the 2016 presidential election, he’s sought to withdraw that plea as the Justice Department argued the FBI had an insufficient basis to interview him in the first place.<\/p>\n

REP. COLLINS SUGGESTS FLYNN JUDGE MAY HAVE ‘CONFLICT OF INTEREST’ AFTER HIRING PERSONAL LAWYER<\/strong><\/a><\/p>\n

Rather than granting the DOJ’s dismissal, Sullivan\u00a0appointed a retired federal judge to argue against the department’s position and to consider whether Flynn needed to be held in criminal contempt for perjury.<\/p>\n

“There’s no question that what\u00a0he seemed to be doing was\u00a0delaying this process,” Wisenberg explained, ” and …\u00a0the D.C. Court of\u00a0appeals [is] saying, ‘You’re going\u00a0against clear law here.\u00a0What are you doing?'”<\/p>\n

Wisenberg said Sullivan is “very popular” among the bar in D.C., calling him a “celebrity in legal circles.”<\/p>\n

“He’s used to that celebrity\u00a0status,” Wisenberg said. “When he appointed this …\u00a0amicus and delayed this\u00a0process, he was praised in the\u00a0press.\u00a0The only problem is the law\u00a0doesn’t let him do it.”<\/p>\n

“He’s\u00a0a celebrity,” Wisenberg added, “but a celebrity in\u00a0trouble.\u00a0He needs a very good lawyer like\u00a0Beth Wilkinson to help explain\u00a0what the heck he’s doing to the\u00a0court of appeals.”<\/p>\n
