A Washington federal judge Friday tossed out Secretary of Education Betsy DeVos’ policy that would have funneled millions in coronavirus relief to private schools in a ruling that has nationwide impact.

U.S. District Judge Dabney Friedrich, a President Trump appointee, vacated the plan DeVos unveiled this summer to divert more of the $16 billion Congress passed in emergency K-12 education funding away from public schools to private schools. The judge found the rule was unlawful and DeVos’ action to better help private schools contrary to Congress’ intent for the money under the CARES Act legislation.

“Thus, the Department’s interim final rule, which conflicts with the unambiguous text of the statute, is void,” Friedrich said in her 13-page ruling.

DEVOS, EDUCATION DEPT. FACE 5-STATE LAWSUIT OVER CORONAVIRUS RELIEF PLAN FOR SCHOOLS

The ruling was in response to a lawsuit filed by the National Association for the Advancement of Colored People (NAACP), public school districts, families and other pro-public school advocates who sued DeVos in federal court. They were concerned that DeVos’ rule, which laid out a new formula for allocation of coronavirus funds, would divert resources away from public schools, whose enrollment is majority non-white, to private schools, with more white and affluent student bodies, data show.

Some states filed separate lawsuits to overturn DeVos’ rule, including Washington, Michigan, California, Maine, New Mexico and Wisconsin. Unlike judges in those cases who issued only preliminary relief, the federal judge Friday made a permanent decision with nationwide scope, said Wendy Lecker, senior attorney at the Education Law Center, which represented the plaintiffs.

“This is a summary judgment, so the case is closed,” Tamerlin Godley, another attorney for the plaintiffs, told Fox News.

Godley, a partner at Munger, Tolles and Olson LLP, said the ruling sends a “powerful” message coming from a federal judge in D.C. and a Trump appointee.

“It’s a strong statement that this was not lawful,” she said.

DEVOS SAYS SCHOOLS MUST STILL HAVE MANDATED STANDARDIZED TESTING DURING CORONAVIRUS PANDEMIC

The Trump administration could appeal the ruling to try to reinstate the policy. A spokesperson for the Education Department Angela Morabito told Fox News Saturday: “We’re studying the decision and considering our options.”

The court ruling was first reported by Politico.

Congress passed the more than $2 trillion CARES Act in March. The massive economic stimulus program addressed the coronavirus pandemic and economic fallout. More than $16 billion was included between two funding programs for K-12 schools: $13.2 billion for the Elementary and Secondary School Education Relief Fund and another $3 billion that governors could use for districts significantly impacted by COVID-19.

DeVos, a longtime advocate for school choice, announced in June a Department of Education rule on how local school districts could spend the money. Instead of allocating funds to private schools based on the number of low-income students in them, she wanted the figure to be based on total private school enrollment in the district, a much larger number. If districts didn’t abide by the formula, how they used their funds could be restricted.

DeVos framed the action as a more equitable way to distribute funds to students regardless of their school.

“The CARES Act is a special, pandemic-related appropriation to benefit all American students, teacher, and families impacted by coronavirus,” DeVos said at the time. “There is nothing in the law Congress passed that would allow districts to discriminate against children and teachers based on private school attendance and employment.”

The impact on some districts was huge. Pasadena Unified School District in California, one of the plaintiffs in the NAACP case, would have to set aside about 2% of its CARES Act funds to private school students. But under DeVos’ rule, the district would have to divert 40% of emergency funding to private schools, Godley said.

DEVOS ACCUSES TEACHERS’ UNIONS OF CONCERNS WITH ‘ALTERNATE AGENDAS’ 

Now, local districts will only have to allocate funds to private schools based on the number of students in poverty going to those private schools, as opposed to the total private school population.

“Getting it fully vacated means everything is set,” Godley said. “They know what their budgets are going to be, and we’ve minimized the amounts that are going to have to go out to private schools.”

More retailers and states are instituting mask requirements, but tensions are mounting for people who see the rules as infringements.

As images of people wearing surgical masks flashed across the screen, Morgan Freeman’s deep, soothing voice delivered a message to America: “When you wear a mask, you have my respect. Because your mask doesn’t protect you, it protects me.”

Using familiar actors, stirring background music and the arresting eyes of people peering out above their masks, a broad national ad campaign unveiled on Thursday by New York State, once the center of the coronavirus pandemic, aimed to educate people about how covering their mouths and noses could save lives.

That it was needed at all — six months since the virus was first detected in the United States — speaks to the lingering fight about the use of masks. At local government meetings and in the checkout lines of big-box stores, Americans continue to wrestle over one of the simplest methods that health officials recommend for stopping the spread of the virus.

A tidal wave of new mask requirements has been issued in the last few days, amid surging cases in many regions, including more than 75,000 new coronavirus cases across the country on Thursday, the most in a single day. Face coverings will be required at stores like Walmart, Target and CVS, and in a growing number of Republican-led states where governors once resisted such mandates.

More than half the states have issued statewide mask requirements, including Arkansas, where Gov. Asa Hutchinson, a Republican, announced a face covering requirement on Thursday, after previously taking a more hands-off approach. Gov. Jared Polis of Colorado, a Democrat, also issued a mask order on Thursday, after questioning whether such a mandate would be enforceable.

But there remains firm resistance in many circles, including from some Republican leaders who view mask requirements as a threat to personal liberty.

Gov. Brian Kemp of Georgia, who announced this week that he was suspending all local mask mandates, filed a lawsuit on Thursday challenging the authority of leaders in Atlanta to require masks inside their city’s limits. As the mayor of Atlanta, the suit said, Keisha Lance Bottoms “does not have the legal authority to modify, change or ignore Governor Kemp’s orders,” only to carry them out.

And in Oklahoma, Gov. Kevin Stitt said this week that he remained opposed to a mask order, even after he became the first governor known to test positive for the virus. “You can’t pick and choose what freedoms you are going to give people,” Mr. Stitt said during the Zoom call on which he announced his positive test.

Masks have been broadly accepted in many European and Asian countries. Britain and France issued nationwide mask orders for certain public places this week, joining a long list of nations that already required them.

But in the United States, there was initially confusion and shifting guidance over masks. The issue became politicized when, even as the Centers for Disease Control and Prevention began urging Americans to wear face coverings, President Trump stressed that the measure was voluntary, and said that he did not think he was “going to be doing it.” Mr. Trump publicly wore a mask for the first time on Saturday.

Early in the pandemic, federal officials instructed Americans not to buy or wear masks. The guidance came in part because of an early, limited understanding of the virus and because of shortages in medical-grade masks, which were needed for essential workers.

In April, the C.D.C. revised that guidance, advising that cloth face coverings were recommended.

Public health officials increasingly see masks as a powerful weapon against the virus, particularly after the World Health Organization acknowledged that the virus can be airborne, with tiny respiratory droplets able to linger in the air for hours. Masks can block dangerous respiratory droplets that would otherwise be spread by infected people, and universal mask wearing can help stop inadvertent transmission by people who are asymptomatic.

In an example cited by the C.D.C. this week, vigilant mask wearing was credited with preventing two ill stylists at a hair salon in Missouri from spreading the virus to nearly 140 clients, none of whom became ill. Dr. Robert R. Redfield, the director of the C.D.C., said in an interview with the Journal of the American Medical Association on Tuesday that if all Americans embraced rigorous mask wearing, the country could control the virus within one to two months.

The vast majority of Americans support wearing masks, polling suggests. According to a Gallup survey conducted online from June 29 to July 5, 72 percent of adults surveyed said they always or very often wore a mask when outside their homes, while 18 percent said they wore a mask rarely or never.

But in some conservative areas, wearing a face covering is also seen as a political and cultural symbol, and mask requirements have been considered a serious infringement.

“It’s absolutely not acceptable in a free world,” said Ammon Bundy, who once led an armed takeover of an Oregon wildlife refuge and was protesting a mask ordinance in Idaho on Thursday.

Idaho has faced a sharp rise in cases and warnings from hospital leaders about the trajectory in the state, and a local health board scheduled a meeting to discuss masks. But a heated discussion emerged on Thursday between protesters and local health officials. A young girl began crying, police officers arrived to calm the situation, and the board canceled the meeting.

In Provo, Utah, dozens of people packed a county commissioners meeting where officials were scheduled to discuss whether students should wear masks when they return to school in the fall. That meeting on Wednesday was postponed shortly after it started — many people in the audience had shown up without masks.

Some in the audience booed the chairman of the commission when he pointed out that the crowd was not following public health guidelines.

“This is the exact opposite of what we need to be doing,” the county chairman, Tanner Ainge, a Republican, said, his mask looped around his ears but lowered to his chin. “We are supposed to be physically distancing, wearing masks.”

Clashing views on masks have grown especially pronounced in parts of the Deep South. The Republican governors of neighboring states, Alabama and Georgia, issued markedly different orders on Wednesday despite facing urgent outbreaks.

Gov. Kay Ivey of Alabama issued a statewide mask order, drawing blowback from some in the ranks of the Republican-held State Legislature, even as Mr. Kemp suspended all local mask mandates, a move that affected at least a dozen cities and drew pledges of defiance from some officials.

“It’s like a rebellion,” said Russell Edwards, a Democrat and the mayor pro tem of Athens-Clarke County, Ga., where Mr. Kemp is from.

Before Mr. Kemp’s suit was filed, Mayor Bottoms of Atlanta, a Democrat who has tested positive for the virus, seemed to anticipate the governor’s challenge of her authority to maintain a mask order. “I am not afraid of the city being sued,” she said, “and I will put our policies up against anyone’s, any day of the week.”

In New York, where the virus hit early and hard, there is fear that opposition to masks in other parts of the country could lead to a resurgence in the state. Gov. Andrew M. Cuomo, a Democrat, on Thursday unveiled the national ad campaign to promote mask wearing with eight 30-second television spots featuring stars such as Robert De Niro and Jamie Foxx.

The campaign comes as New York — which managed to slow an outbreak that has resulted in more than 30,000 deaths — is trying to prevent the virus from seeping back into the state. Travelers from 22 states where cases are rising are supposed to quarantine for 14 days upon arrival in New York.

“We can only beat this virus if we are united as one, not divided by ideology or politics,” Mr. Cuomo said, adding: “I wear a mask to protect you and you wear a mask to protect me. It is simple as that.”

Republican governors in states with surging cases are increasingly facing pressures from all sides. After Gov. Greg Abbott of Texas reversed his position on face masks and issued a statewide order, Republican groups in a handful of counties passed resolutions censuring him. While the resolutions are symbolic, they are among the strongest ways local leaders can voice their disapproval.

Mr. Abbott defended his mask order on Thursday as necessary to prevent another stay-at-home order. “I know that many of you all are frustrated — so am I. I know that many of you do not like the mask requirement — I don’t either,” he said in a video message at the virtual state Republican convention. “The last thing that any of us want is to lock Texas back down again. We must do all that we can to prevent that.”

In Oklahoma, Governor Stitt has enjoyed support from fellow Republicans for his approach to face masks. He has not issued a statewide order and routinely makes public appearances without a mask — at meetings at the State Capitol, at Mr. Trump’s rally in Tulsa last month and, recently, at a Walmart in Oklahoma City.

Mr. Stitt’s support from allies appeared unchanged after he tested positive for the virus.

“It hasn’t changed his view on it — it doesn’t change my view on it,” State Senator Nathan Dahm, who is a Republican from the Tulsa suburb of Broken Arrow and who remains opposed to a statewide mandate. “He understands the risk of wearing a mask or not wearing a mask. That was his choice. We wish him a speedy recovery.”

The state’s urban centers, though, are moving toward requiring masks. The Tulsa City Council passed a mask ordinance on Wednesday, deciding in a 7-2 vote to require people to wear a face covering in a business, school or public place, and the City Council in Oklahoma City was set to vote on a similar citywide indoor mask ordinance on Friday.

Mr. Dahm said he also opposed the local ordinances. While he said he carried a mask with him, and would wear it if required to do so to enter a business or if someone he was talking with asked him to wear it, “my default is to not wear a mask.”

Karen Keith, a Democrat and a commissioner in Tulsa County, said she considered herself “the queen of wearing a mask.”

Nevertheless, she is now among the growing number of Oklahomans who have contracted the virus, which she said she believed she picked up while on a road trip through Texas, at a convenience store where few people were masked.

“Good Lord, people, you have to wear a seatbelt. You have to have a driver’s license. You can’t drive while you’re drunk,” she said. “There are all sorts of rules and regulations that you have to follow every single day. This is not some infringement on anybody’s rights.”

In your book, you describe a drinking game, Neknomination, that started on Facebook and YouTube in 2014 in Australia and “went viral.” You studied it when it came to England, and you correctly predicted the game would die out quickly. How did you come to that conclusion?

In Neknomination, people were downing pints of beer and large quantities of alcohol. Each person would do it, post a video online and nominate two or three others to outdo them. Those people had to meet the challenge and nominate others within 24 hours. In studying it, we had two bits of information that are really hard to get at in disease outbreak: the reproduction number — how many others one person “infects” — and the lag time, 24 hours, after which people would stop spreading the game. Friends tend to cluster together and nominate the same people. That reduces the reproduction number below one and leads to a smaller outbreak. Despite a media frenzy in early February 2014, [the game] was all but gone by the end of that month.

Talk about the importance of the reproduction rate in contagion.

It’s the mathematics of exponential spread. For each case of COVID-19 you have, how many others are you infecting? In the early stages of this pandemic, the reproduction number, or “R,” was 2 to 3. Now, in many countries, it’s in the 0.8–1.2 range. Anything above 1 means it’s going to grow. If you bring the “R” rate down below 1, it means one person infects fewer than one other person, and you can say the spread of the disease is under control and will eventually die out. If the “R” is .95, you will have a declining epidemic.

Even though the epidemic is in decline with an “R” of less than 1, some people will continue to get infected, get sick and even die, correct?

Yes, that’s a good point. There could be a large number of individuals still getting sick as transmission slows. You can’t think that when you get to an “R” number below 1, the problem is solved.

How far into the future can you predict how a virus will spread?

The hard thing about predicting the future for COVID-19 is that it’s so dependent on what governments do and what individuals do. You can see a lot of different scenarios depending on what people do. Models can be a useful way of laying out the possibilities. If you lock down longer, this is what will happen; if you lift the lockdown early, then this is what will happen. But a much larger question is what governments and people do with the information. Some countries might think a predicted level of contagion is acceptable. Other countries will think that same level of contagion is too high, and they need to put more measures in place for a longer time.

Contact tracing has been identified as a key element in stopping spread: finding all those in contact with a newly diagnosed case. Can that work in other areas, like stopping the spread of gun violence?

In a pandemic, you identify a patient and then you identify others in that person’s network that they’ve been in contact with. You quarantine them all, and that should stop transmission. Violent events can also spread through definable networks like gangs. If you have a shooting, you try to find other people connected through friends, gangs or other networks. Some communities have what they call violence interrupters — a well-known person in the community who has credibility. They might find friends of a gunshot victim and talk to them about the danger and futility of retaliation.

How do you think this pandemic is going to unfold?

It’s often hard to imagine what might have happened had you done something differently. But we can watch different scenarios. Some countries, like New Zealand, had early travel restrictions and now have local control. With border restrictions, they might be able to keep that going. Other places, like Hong Kong and South Korea, are keeping the pandemic under control but with flare-ups. Some places in Europe and the U.S. are lifting lockdowns, but they’re doing it differently — with or without various substitute measures, like testing, contact tracing, mandatory masks and social distancing. And still other places, like India and South Africa, are not able to keep lockdown measures in place.

With this pandemic, we’ll see alternative realities play out in real time with wide variations around the world. Things aren’t going to look the same for a long time.

Gov. Gavin Newsom on Wednesday said his administration will release guidelines “in a week or so” for allowing gyms, yoga studios and other fitness facilities to reopen, though stringent safeguards will need to be adopted to protect customers from the COVID-19 pandemic.

Newsom cautioned that the state directives will be tailored to the unique characteristics of each business, from large fitness chains to small studios, and will rely heavily on the advice of public health officials in each county.

The governor made the comments during an online roundtable with fitness professionals and business owners Wednesday morning, saying he hopes to allow them to be back in business as soon as possible.

“We also recognize your sector is multifaceted and we don’t want to be naive and just put out something that’s bland and that doesn’t meet your unique criteria and your unique considerations,” Newsom said.

The news comes as Dr. Sara Cody, Santa Clara County’s public health officer who was a key figure in crafting the San Francisco Bay Area’s shelter-in-place order, the first of its kind in the U.S., said she was concerned with the Newsom administration’s decision to allow gatherings of up to 100 people for religious, cultural or political reasons and the “increased frequency” with which the state is lifting coronavirus restrictions.

Newsom said that 47 of California’s 58 counties had met the state’s regional standards to ease his stay-at-home order, which include preparations to increase hospital capacity, testing and supplies of protective equipment. That has allowed retailers in most of the state to open, as well as hair salons and barbershops.

The governor‘s chief of staff, Ann O’Leary, said the draft guidelines to reopen the fitness industry are currently being reviewed by state public health officials and that she expects those directives to be released within a week.

Adam Attia, owner of Fitness Rangers in Sacramento, told the governor that the closure, put in place in March to stem the spread of the coronavirus, has been financially and personally devastating. He told the governor he needs to reopen soon — within a week or so — if he hopes to stay in business.

“We’re desperate. We want to go back into the gym. We’re doing everything we can to keep our members engaged,” Attia told Newsom during the meeting, which streamed on YouTube. “We’re at a point where I’m going to have to lay everyone off. I may have to close my doors permanently if we can’t reopen soon. We really need your support.”

Francesca Schuler, chief executive of In-Shape Health Clubs, also emphasized how essential the fitness industry is to Californians.

“We’re one of the only industries that’s really in preventative healthcare of the community so impacted by COVID-19. Many of them are individuals who struggle with chronic illnesses., usually, diabetes, high blood pressure,” Schuler told the governor.

This week, Newsom unveiled the new directive for salons and issued statewide guidelines for religious services, calling on houses of worship to limit attendance to 25% of capacity of their buildings, conduct health screenings of congregants and take other precautions to prevent the spread of COVID-19.

The Newsom administration on Monday also allowed retail stores to reopen, shifting away from an earlier patchwork approach that permitted in-person shopping only in counties that met the state’s criteria. Retailers are advised to limit the number of patrons in stores at one time, urge employees and customers to wear face masks, and provide hand sanitizer, in addition to other guidelines.

Under Newsom’s original four-stage reopening plan, hair salons, barbershops, nail salons and other grooming services, gyms, sports competitions in empty stadiums and religious services were set to open in Stage 3.

The fourth and final stage would mark the end of the stay-at-home order and all restrictions, allowing people to return to concerts and sporting events, which the governor previously noted was unlikely to occur until a vaccine became widely available.

Trump made the remarks about moving the convention from Charlotte, North Carolina in a series of tweets Monday morning, where he suggested the governor should guarantee the convention can accommodate “thousands of enthusiastic Republicans” for its planned Aug. 24-27 dates.

In a tweet Monday afternoon, Trump denied he’d want the convention moved to his golf resort or any sort of hotel ballroom in Florida, saying “Ballroom is not nearly big enough & would like to stay in N.C.” as a response to New York Times reporting saying that the president has asked aides why the convention can’t just be held in a Florida hotel ballroom.

Earlier this month, Trump accused Cooper of “playing politics” with the state’s reopening, which is going through a phased process like many other states, moving to Phase 2 of its reopening last Friday.

Though the state could officially end its phased reopening earlier this summer, it’s unclear whether a convention potentially packing tens of thousands into the Spectrum Center in downtown Charlotte would be allowed to go on.

Democrats — who plan to hold their convention Aug. 17-20 in Milwaukee, Wisconsin — may end up holding a virtual convention if an in-person event seems unfeasible.

Speaking on Fox News Monday morning, Vice President Mike Pence echoed Trump’s call to continue holding the convention, saying Trump’s request of Cooper was ““very reasonable,” while also singling out Texas, Florida and Georgia as state’s he feels have made strong progress reopening.

“They must be immediately given an answer by the Governor as to whether or not the space will be allowed to be fully occupied,” Trump said of Republicans. “If not, we will be reluctantly forced to find, with all of the jobs and economic development it brings, another Republican National Convention site. KEY BACKGROUND

The Republican National Convention would mainly serve as a formality of sorts for Trump as Republican nominee, since he didn’t face any real competition in this year’s Republican primaries. Conventions are also typically followed by a boost in the nominee’s standing in the polls, with the Republican convention being held later than the Democratic one this year meaning that Trump would likely get a boost closer to the actual Nov. 3 election date.

The RNC site selection committee chose Charlotte as the host city in 2018, after it was the only city to officially submit a bid. The choice of the city was seen as a wise one for Republicans given North Carolina’s status as a swing state.

Though Trump managed to defeat Democratic nominee Hillary Clinton by a little over 3 percentage points — with Clinton even holding her final campaign rally in the state —that didn’t translate down ballot to the governor’s race, which saw Cooper narrowly defeat Republican incumbent Pat McCrory.

Barack Obama was the most recent Democratic nominee to carry the state, winning it over John McCain in 2008 but failing to keep it blue in his 2012 reelection, which saw Mitt Romney win the state.

TANGENT

Like many states that have taken a phased approach to reopening, Cooper’s decisions have been met by many with disapproval and protest. The latest event is scheduled to happen Monday, with “Freedom Rally” protests organized by the group Reopen NC planned in cities across the state.
