Newly released records from the Department of Justice show that the cell phones of multiple people on then-Special Counsel Robert Mueller’s investigative team were “wiped” for various reasons during the probe.

The records show at least several dozen phones were wiped of information because of forgotten passcodes, irreparable screen damage, loss of the device, intentional deletion or other reasons — and came before the DOJ’s Office of Inspector General (OIG) could review the devices.

The documents show that Mueller deputy Andrew Weissman “accidentally wiped” his phone twice after entering the wrong passcode too many times in March 2018. Lawyer James Quarles’ phone “wiped itself” without his intervention, the records say.

The documents were released after a lawsuit from the conservative watchdog group Judicial Watch. They were first reported by Sean Davis of the Federalist.

The records indicate Attorney Greg Andres phone was also wiped due to a forgotten passcode. And they say the phones of both Mueller deputy Kyle Freeny and Rush Atkinson were wiped accidentally after they entered the wrong passcode too many times.

The records say that a phone belonging to FBI lawyer Lisa Page – whose anti-Trump texts with FBI agent Peter Strzok were of interest to investigators — was restored to factory settings when the inspector general’s office received it.

Other officials, whose names are redacted, claim to have unintentionally restored their phone to its factory settings, deleting all records of communication.

Next to the name of one redacted person, the record says: “Phone was in airplane mode, no passcode provided, data unable to be recovered so had to be wiped.”

Mueller’s investigation yielded no evidence of criminal conspiracy or coordination between the Trump campaign and Russian officials during the election, although it did find that the Russian government “interfered in the 2016 presidential election in sweeping and systemic fashion.” The question of whether Trump obstructed justice was not answered, but it did state that the final report “does not exonerate [Trump]” on this matter.

The OIG opened an investigation into possible bias in the origins of the Russia Investigation, but determined that the FBI complied with policies in launching the politically explosive probe. Still, the OIG flagged “significant concerns with how certain aspects of the investigation were conducted and supervised.”

DURHAM OBJECTS TO IG FINDINGS ON RUSSIA PROBE ORIGINS 

Specifically, the report concluded that investigators found no intentional misconduct or political bias surrounding the probe’s launch and efforts to seek a controversial Foreign Intelligence Surveillance Act (FISA) warrant to monitor former Trump campaign adviser Carter Page in the early months of the investigation.

The same report also faulted the FBI over numerous errors in the application process. The IG probe identified at least 17 “significant inaccuracies and omissions” in the Page applications and said they would launch a new audit into the FISA process. IG Michael Horowitz and his investigators were at times sharply critical of the bureau’s handling of the case, including for failing to share information that would have undercut claims in those documents.

Attorney General Bill Barr publicly disagreed with the findings of his colleague, Inspector General Michael Horowitz.

MORE DURHAM CHARGES POSSIBLE, BARR SAYS 

In a statement at the time, Barr shared Trump’s views that the initial investigation was invasive and launched on the “thinnest of suspicions.”

“The inspector general’s report now makes clear that the FBI launched an intrusive investigation of a U.S. presidential campaign on the thinnest of suspicions that, in my view, were insufficient to justify the steps taken,” Barr said.

U.S. Attorney John Durham, tasked by Barr in May 2019 with conducting his own investigation of the Russia probe’s origins, also disagreed with Horowitz’ findings. 

“Based on the evidence collected to date, and while our investigation is ongoing, last month we advised the Inspector General that we do not agree with some of the report’s conclusions as to predication and how the FBI case was opened,” Durham said in a statement.

Stocks rallied to record highs Friday morning as the race for the White House officially got under way after President Trump accepted the presidential nomination of the Republican Party.

The Dow Jones Industrial Average gained 62 points, or 0.22%, in the opening minutes of trading and topped its 2019 closing value of 28,538.44.

Meanwhile, the S&P 500 and the Nasdaq Composite were higher by 0.23% and 0.54%, respectively, as both looked to extend their longest streak of record closes in 2020. The S&P has closed at an all-time high in four consecutive sessions while the Nasdaq has settled at a new peak for five straight trading days.

Trump, in his acceptance speech for the Republican nominee, drew a sharp contrast between his policies and those of former Vice President Joe Biden on Thursday evening, saying he would “again build the greatest economy in history” and that Biden was the “destroyer of America’s jobs.”

Trump also said that he was the president of law and order while arguing “no one will be safe in Biden’s America.”

Election Day is 67 days away.

Looking at stocks, Abbott Laboratories reached a $750 million deal with the White House to supply 150 million rapid COVID-19 tests. The $5 test, which received Food and Drug Administration emergency use authorization on Wednesday, will begin shipping in September.

Apple Inc. and Tesla Inc. are in focus as both companies will split their stocks at the close of trading on Friday. Apple investors will receive an additional three shares for each share owned while Tesla investors will receive four.

Coca-Cola Co. will offer voluntary separation packages to 4,000 employees as it restructures its business into nine operating units from 17. The company says the reorganization will result in $350 million to $550 million in severance expenses.

Looking at earnings, Hewlett-Packard Co. reported strong quarterly results as the work-from-home environment fueled by the COVID-19 pandemic produced a 32% increase in notebook computer sales.

Meanwhile, rival Dell Technologies Inc. also posted solid results as amid double digit growth in consumer devices, including notebooks, commercial notebooks and premium consumer PCs, saw

Big Lots Inc. reported better-than-expected top and bottom line results as discount shoppers thronged the company’s stores and website in the wake of COVID-19. Adjusted earnings of $2.75 per share were a record for the April through June period.

Looking at commodities, gold surged $33 to $1965.60 and West Texas Intermediate crude oil edged up 8 cents to $43.12 per barrel.

U.S. Treasurys were little changed with the yield on the 10-year note holding near 0.74%.

At least 15 people were killed in Portland during the month of July, which was the highest number of deadly shootings or stabbings in a single month since the 1980s, according to authorities.

Police Chief Chuck Lovell addressed last month’s violence which ended on Friday following a 150-round shooting at an apartment building in the city. So far this year, 24 people in Portland have died in homicides.

“That’s very concerning to know that that many people have been killed in such a short period of time,” Lovell said on Thursday, according to Portland’s KATU. “These numbers were not acceptable.”

To solve the recent crimes, Lovell said the police bureau pulled officers from an “already diminished patrol” unit to help work on follow-up investigations.

“Our job, number one for us, is public safety and preservation of life. So we are, we’re going to resource some more people to the detective division to help follow up and do some investigation on those,” Lovell said. “It’s incumbent upon us as public safety professionals and police officers to go out and still do that work.”

He remarked how the bureau was forced to cut its Gun Violence Reduction Team at the direction of the City Council, which has made their job more difficult.

The 34-member team was broken up on July 1 following budget cuts to police units that reportedly targeted a disproportionate number of Black people in traffic stops, according to The Oregonian. It was the first month without the unit in more than a decade.

“What was really lost was the follow-up piece, picking up video, contacting people,” Lovell said.

Portland City Commissioner Jo Ann Hardesty pushed to disband the Gun Violence Reduction Team, which was called a gang enforcement unit at the time, according to the station. She did so following a 2018 city audit which found that African Americans made up 59 percent of the unit’s traffic stops in 2016.

“I don’t think it’s a staffing issue, and no matter how often they say they’re overworked and underpaid, the reality is that Portland police have for a long time decided what they will investigate and what they won’t,” Hardesty said.

Shootings have also increased in July compared to the same time last year. There were a total of 63 shootings last month compared to 28 in July 2019, according to the Police Bureau.

In terms of the response times of officers, it took police almost 15 minutes to respond to a shots-fired call this year, compared to just under seven minutes last year, the station reported. Police had told KATU the ongoing nightly demonstrations in the city had strained the department’s resources.

Homicides, assaults, burglaries, and vandalism are also up when compared to last year, according to The Oregonian. Meanwhile, total person-to-person and property crimes are down from earlier years, police said.

One day after a record-breaking number of new coronavirus infections, California has surpassed 400,000 overall cases, data from the Los Angeles Times tracker show.

By comparison, the New York Health Department has reported more than 408,000 infections. But that state has reported more than 25,000 deaths, while California’s death toll is approaching 8,000.

The news comes after California again reported its highest number of coronavirus cases in a single day, with 11,554 cases recorded Monday, according to the The Times’ tally of reports from the state’s 58 counties.

That number surpasses a record broken just one week ago, when 11,142 cases were reported.

In Los Angeles County, officials on Tuesday reported 50 additional coronavirus-related deaths and 2,741 new cases. Individuals who are 41 and younger account for about 57% of the new cases — an ongoing trend that county officials have said confirms that younger people are driving the spread of the virus.

There are 2,218 people hospitalized for the virus. Of those, 26% are in intensive care.

The state is also reporting worsening death tolls. The seven-day average of coronavirus-related deaths has been hovering between 91 and 99 each day since July 10, the worst it has been since the pandemic began.

For the weeklong period that ended Monday, 674 deaths were reported in California, the highest weekly total to date. In the previous seven-day period, 640 died, which had also been a weekly record; the week before that, it was 474.

Coronavirus-related hospitalizations are also at record-breaking levels. In fact, records have been broken for 28 of the last 30 days, including Sunday, when 6,921 people statewide were reported in hospitals.

In Ventura County, 207 new cases put the area five short of 6,000, Rigoberto Vargas, the county’s director of public health, told the Board of Supervisors on Tuesday.

More than 1,500 people have been tested since Friday, Vargas said. The percentage of those found to be positive among all 97,124 who have been tested is roughly 6.2%.

Ventura County has reported four deaths since Friday, bringing its toll to 62, nearly double that of neighboring and smaller Santa Barbara County, which has recorded 32 deaths. Ventura’s mortality rate rose to 1.04%, higher than that of Santa Barbara, 0.7%, but lower than Los Angeles County, at 2.6%, Vargas said.

Hospitalizations in Ventura have risen to 95, a jump from 89 on Sunday but still lower than a high of 101 early last week. Of that group, 24 are in intensive care.

“The last two or three days, the numbers have been in the lower 80s, lower 90s, so hopefully the 95 will come back much lower the next few days,” Vargas said. “We’re really keeping our fingers crossed.”

In Orange County, the number of overall cases is now the second-highest in the state.

The cumulative COVID-19 case count in Orange County was 29,986 Tuesday, just ahead of Riverside County’s 29,983. Only Los Angeles County has more, with nearly 160,000 cases.

Despite the grim news around the state, there are signs the situation may be improving after a shutdown of indoor services at businesses including bars and restaurants, closures that have been underway for the last three weeks.

Hospitalizations grew by 7% Sunday, compared with the previous Sunday; that’s an improvement over July 12, when hospitalizations were up by 12% over the previous Sunday. On July 5, hospitalizations had grown by 21% over the previous Sunday; and on June 28, the figure was 29%.

Also, the rate at which coronavirus tests are coming back positive may have finally stabilized, although it is probably too early to know whether that trend will continue.

On Monday, Gov. Gavin Newsom said the so-called positivity rate over the previous seven days was 7.2%; it had been 7.7% the previous Monday.

On Friday, Dr. Mark Ghaly, secretary of California’s Health and Human Services Agency, said he was encouraged by the stability in the positivity rate after weeks of increases. In late May, the positivity rate was around 4%.

Ghaly suggested Friday that it is too early to call it a trend, but if the positivity rate continues to fall, it could mean that the reclosure of some businesses is working to help control the spread of the disease.

“As soon as we feel confident in that trend and we see other numbers start to stabilize, we’ll credit some of the moves we made over the last few weeks,” Ghaly said. “It’s been about three, four weeks since we … first started to make moves … so we’re right in that time period where we may see some of the changes in the benefits of those [policy changes].”

It was just over three weeks ago — June 28 — that Newsom ordered bars closed in seven counties, including Los Angeles. On July 1, he ordered the closure of bars and indoor restaurant dining rooms in 19 of the state’s worst-hit counties, affecting 72% of the state’s population.

Newsom expanded the shutdown last week, ordering the closure of all bars and indoor dining statewide. He also shuttered the indoor operations of a number of businesses — including gyms, malls, hair and nail salons, places of worship and offices for nonessential industries — in dozens of counties.

Some of the areas with the worst per capita coronavirus rates are in counties with state prisons hit hard by outbreaks. Lassen County in the remote northeast corner of California is reporting 805 cases per 100,000 residents in the last 14 days, and Marin County is reporting 565 cases per 100,000 residents.

Imperial County in the southeastern corner of the state is still suffering, with 786 cases per 100,000 residents. The Central Valley is also hard hit, with case rates in Stanislaus, Madera, Kings, Kern, Merced, Fresno and Tulare counties ranging from 400 to 700 per 100,000 residents.

Of the state’s southern urban and suburban counties, L.A. County is reporting 420 cases per 100,000 residents; San Bernardino County, 410; Riverside, 396; Orange, 383; Ventura, 231; and San Diego, 216.

Northern California’s metro areas have reported lower numbers, with Sacramento County reporting 194 cases per 100,000 residents; San Francisco, 151; and Santa Clara County, home to Silicon Valley, reporting 124.

The state’s target for keeping the coronavirus under control is no more than 100 cases per 100,000 residents over the previous 14 days.
