]]>Derek Chauvin and Tou Thao — two of the officers involved in killing George Floyd May 25 — both took department training on preventing suffocation in people being restrained face down, the Minneapolis Police Department confirmed.
In one of his most forceful comments yet on Floyd’s killing, Minneapolis Police Chief Medaria Arradondo issued a statement Monday night, saying, “Chauvin knew what he was doing.”
“Mr. George Floyd’s tragic death was not due to a lack of training — the training was there,” he said. “This was murder — it wasn’t a lack of training. This is why I took swift action regarding the involved officers’ employment with MPD,” Arradondo said.
While a number of public officials in Minnesota, including Gov. Tim Walz, have started calling Floyd’s killing a murder, it appears to be the first such public statement by the police chief. Department of Public Safety Commissioner John Harrington called Floyd’s death “murder” on May 29, just hours before Chauvin was charged with second-degree murder, third-degree murder and manslaughter.
Arradondo released his statement late Monday in response to public records requests for specific training records after questions were raised about whether the Minneapolis Police Department ever fulfilled a promise in a 2013 settlement to require all sworn officers to undergo training on the dangers of positional asphyxia.
Arradondo said that the MPD “went beyond the requirements” of the settlement. It not only provided the training, he said, but changed its policies in 2014 to “explicitly require moving an arrestee from a prone position to a recovery position when the maximal restraint technique is used and require continuous monitoring of an arrestee’s condition.”
He went on to say that the MPD continues to emphasize training on the tactics: “There is simply no way that any competent officer in MPD would be unaware of the need to get an arrestee into a recovery position so that he or she can breathe freely.”
Chauvin’s lawyer, Eric Nelson, is not commenting on the case.
The 2013 settlement stemmed from a lawsuit filed by the family of David Cornelius Smith, a black man who died in 2010 after police pinned him face down, while handcuffed, on the floor of the downtown YMCA in Minneapolis. The city paid the family $3 million to settle the claims.
Earlier this month, Smith’s sister Angela Smith and a family lawyer made an impassioned plea to the city’s civilian Police Conduct Oversight Commission to find out whether the training the family won as part of its settlement was ever conducted.
In an interview, Jeff Storms, a lawyer who represented the Smith family in its lawsuit, said he wants to verify the chief’s claim.
“The statement that was released by the chief does not satisfy our concerns and we will continue to do our due diligence to ensure that the settlement agreement was complied with,” he said.
In a WCCO television interview Tuesday, Lt. Bob Kroll, the head of the Minneapolis Police union representing rank-and-file officers, said he did not disagree with Arradondo’s statement.
“From what we’ve seen there, it’s very tough to refute that,” Kroll said in the interview. “But that’s for the criminal justice system to decide.”
Afsheen Foroozan, chairman of the Police Conduct Oversight Commission, could not immediately be reached for comment. Commission member Abigail Cerra said she couldn’t speak for the commission, but added that as a lawyer she was “stunned” by the statement.
“As a prosecutor I would jump on that, calling Rondo as a witness and having Rondo testify about the training that was provided, how often it was provided, testifying as to which officers attended the training,” Cerra said.
Cerra, who, along with the Star Tribune filed public records requests for the training data, said she still hasn’t received a response from the MPD and wants to see the records.
“It’s taken three weeks to get an answer about was this training requirement met,” she said.
Marshall Tanick, a defense attorney who has represented law enforcement personnel, said he was “flabbergasted” by Arradondo’s statement.
“It could significantly prejudice his right to a fair trial,” Tanick said of Chauvin. “I’m fairly sure that the defense team will raise this comment in conjunction with other comments made by public officials to seek dismissal of the charges or at least a change of venue.”

]]>The special session was held after 54 African countries called for a discussion on the “current racially inspired human rights violations, systematic racism, police brutality against people of African descent and violence against peaceful protests” in the United States. The two-day debate will continue tomorrow at 9 a.m. ET, after which the Council’s 47 members will vote on whether to establish an independent inquiry into U.S. racism and police brutality.
Dozens of speakers lashed out at the U.S. — the world’s most powerful country and the biggest financial contributor to the United Nations, overall — in a highly unusual diplomatic scene, chaired by Council President Elisabeth Tichy-Fisslberger of Austria.
At times the discussion turned into a platform for America’s foes, including Iran, which described George Floyd’s killing as a “public execution” at odds with Martin Luther King Jr.’s vision for a peaceful American society, and Cuba, which called severe racism “not the exception” but “part and parcel” of American life.
The debate was the realization of an effort begun by civil rights activist Malcolm X in 1964, when he urged African states to call out the U.S. over racism and government discrimination and brutality. Fifty-six years later, many of the same problems exist in the U.S. What’s changed is that African nations are now more established and organized at the United Nations, with more political capital to spend highlighting problems outside their own borders.
Speaking for the African Union group of 54 countries, the Central African Republic representative described George Floyd’s killing as “utterly unjustified,” while Somalia sought to put the issue in the context of other global challenges, calling racism “more dangerous than Covid-19.”
South Africa’s Phumzile Mlambo-Ngcuka — the executive director of UN Women — recalled her involvement in South Africa’s anti-Apartheid movement, and urged a similar international outcry at the situation in the United States.
The U.S. had no opportunity to respond. The Trump administration pulled the country out of the U.N. body in 2018, citing the prominent role played at the forum by notable human rights violators including Syria, Sudan and Saudi Arabia, and what Nikki Haley, then U.S. Ambassador to the U.N., described as the body’s “unending hostility towards Israel.” U.S. criticism of the Council dates back to its formation in 2006 when George W. Bush’s Republican administration declined to take up a seat — a position reversed in 2009 by Democratic President Barack Obama.
Ambassador Andrew Bremberg, who heads the U.S. mission in Geneva, said in a statement that the U.S. “recognizes and is committed to addressing its shortcomings including racial discrimination.” Bremberg added that “any (U.N.) resolution on this topic that calls out countries by name should be inclusive” of other countries with deep problems.
Many of the speakers at today’s session, particularly U.S. allies, sought to emphasize that racism is not just an American problem but a global one. “None of our countries is immune” said Karin Bolin, Sweden’s representative.
Croatia spoke on behalf of 27 EU countries and a group of smaller European countries saying: “We need to look into our own souls” and “put an end to such hate crimes” and “remain vigilant against the excessive use of force,” Croatia said.
Speaking just before voting closed in the election for temporary members to the U.N. Security Council, Canada, one of the candidate countries, spoke about its own racism problem, rather than the situation in the U.S.
Canada’s representative said that “systemic racism” continues to be the reality of black Canadians, indigenous Canadians and other groups. “There are no easy fixes: it will require sustained commitment from all quarters of society”
Azerbaijan, on behalf of the 125 countries in the Non-Aligned Movement, complained about the increased use of “mass media” in disseminating hate speech, but was careful to emphasize that racism is a problem “in all spheres of life and in all parts of the world.”

George Floyd struggled desperately to make himself heard during his arrest. With a Minneapolis police officer’s knee planted on his neck for more than 8 minutes, he pleaded for help, said he couldn’t breathe — and finally, fell silent.
On Wednesday, more than three weeks after Floyd’s killing, his brother raised a voice on his behalf in a message to international diplomats.
“My brother, George Floyd, is one of the many black men and women that have been murdered by police in recent years. The sad truth is that the case is not unique,” Philonise Floyd told the U.N. Human Rights Council in a remote address Wednesday.
“The way you saw my brother tortured and murdered on camera is the way black people are treated by police in America. You watched my brother die. That could have been me.”
During a quickly convened session of the Human Rights Council in Geneva, Floyd asked the group to set up a commission of inquiry into racism and police brutality in the United States — specifically “police killings of black people and America and the violence used against peaceful protesters.”
“I’m asking you to help him. I’m asking you to help me,” he added. “I am asking you to help us: black people in America.”
Under U.N. guidelines, commissions of inquiry are in effect fact-finding missions. They are aimed at not only gathering information but also recommending “measures to redress violations, provide justice and reparation to victims, and hold perpetrators to account.”
The Office of the High Commissioner for Human Rights has pursued dozens of international commissions of inquiry over the past three decades, from Rwanda to Syria.
The current high commissioner, former Chilean President Michelle Bachelet, led Wednesday’s session. She opened with a call for “swift reforms and decisions” targeting systemic discrimination and supporting “people of African descent across the world.”
“We should go beyond existing recommendations. We need to build on what has worked from the enormous body of work and experience we already have,” she told the assembled diplomats. “Time is of the essence. Patience has run out. Black lives matter. Indigenous lives matter. Their life with people of color matter. All human beings are born equal in dignity and rights.”
The conversation unfolded without an official U.S. representative present, because the Trump administration withdrew from the Human Rights Council roughly two years ago. Nikki Haley, then the U.S. ambassador to the United Nations, pointed to the membership of countries such as China and Venezuela and dismissed the council as “a hypocritical and self-serving organization.”
So on Wednesday, Ambassador Andrew Bremberg, the U.S. representative in Geneva, looked on from afar as the 47-member body took up a debate proposed by a group of African states led by Burkina Faso.
“We are not above scrutiny; however, any HRC resolution on this topic that calls out countries by name should be inclusive, noting the many countries where racism is a problem to be addressed,” Bremberg said in comments emailed to NPR. And he alluded to violence and discrimination practiced by some of the council’s member states.
“It is time,” Bremberg added, “that those regimes, and others like them, be held accountable by the Council and the world.”

]]>George Floyd’s brother Philonise spoke out against the growing movement to defund the police on Sunday, telling Fox News’ Arthel Neville that officers can do their jobs “and still maintain respect for others.”
“What I would like is for all police around America to get their jobs and do them the right way, the correct way. Innocent people shouldn’t have to die,” Philonise Floyd said on “America’s News HQ.” “You can do your job and still maintain respect for others.”
Floyd’s comments came amid growing calls to weaken law enforcement in the wake of his brother’s May 25 death. As violent protests erupted across the nation, the Black Lives Matter movement announced a “call for a national defunding of police,” which has gained support among notable Democrats and celebrities.

Floyd family attorney Benjamin Crump told Neville that the push to defund police departments “has not come from Philonise Floyd’s family or anybody working with us.”
“We want to try to work to say we need to do restructuring and we need to work together and in concert to try to solve this problem,” Crump explained. “This is not a black problem. This is not a white problem. This is an American problem, and the only way we can heal this country is by working together.”
‘DEFUND THE POLICE’ WRESTS SUPPORT FROM POLITICIANS COAST-TO-COAST
During his emotional testimony last week before lawmakers, Philonise Floyd called for police-reform legislation that, among other provisions, would ban the chokehold that a Minneapolis police officer was seen using against his older brother.
On Fox News, Crump said the family also was calling for the mandatory use of body-cameras, but emphasized a willingness to work together with law enforcement to “come up with solutions” instead of supporting the abolition of police departments across the country.
“What we want is people from both sides of the aisle, people from communities of color, community partners, to get with law enforcement,” Crump explained, “so we don’t continue to have… black people being killed by the police unjustifiably and unnecessarily and senselessly, and nobody being held accountable.”

Asked at another point in the interview to comment on the Friday night police shooting of Rayshard Brooks, Philonise Floyd sent his “condolences to the family,” but emphasized that “his particular case, it was nothing like my brother’s case.”

]]>Philonise Floyd, George Floyd’s younger brother, told lawmakers on Wednesday he wants to ensure his brother’s death means change for the country.
In an emotional opening statement at the House’s hearing on police brutality, Mr. Floyd described how his brother sacrificed for others in his life and tried to follow police orders on the day he died in Minnesota while in police custody.
“I can’t tell you the kind of pain you feel when you watch something like that. When you watch your big brother, who you’ve looked up to your whole life, die — die begging for your mom,” Mr. Floyd said.
“I’m tired. I’m tired of the pain I’m feeling now, and I’m tired of the pain I feel every time another black person is killed for no reason,” he added. “I’m here today to ask you to make it stop. Stop the pain. Stop us from being killed.”
Both House Judiciary Chair Jerrold Nadler, New York Democrat, and Ranking Member Jim Jordan, Ohio Republican, offered their condolences for Mr. Floyd’s loss.
Mr. Floyd died after a white former police officer, Derek Chauvin, kneeled on his neck for eight minutes and 46 seconds. The killing went viral online, sparking nationwide and global outrage and renewed the debate on racial inequality and calls for police reform.
Mr. Chauvin was charged with second-degree murder.
The other former officers on the scene — Thomas Lane, J. Alexander Kueng, and Tou Thao — were also charged on Wednesday with aiding and abetting murder and aiding and abetting manslaughter.
Wednesday’s hearing comes as Democrats work on moving forward with their sweeping overhaul on policing in the U.S. that would mandate anti-bias training, impose national use-of-force standards and make it easier to sue officers for misconduct in the line of duty.
“If his death ends up changing the world for the better — and I think it will, I think it has — then he died as he lived. It is on you to make sure his death isn’t in vain,” Mr. Floyd said.

]]>The brother of George Floyd is scheduled to testify Wednesday at a House hearing on racial profiling and police brutality, coming after riots and protests engulfed the country in response to Floyd’s death — and amid a growing push to abolish, reform or defund police departments.
The House Judiciary Committee hearing will see testimony from Philonise Floyd, who is expected to testify about the implications of his brother’s death in police custody in Minneapolis last month.
GEORGE FLOYD’S BROTHER TO TESTIFY ON CAPITOL HILL: WHAT TO KNOW
The hearing seeks “to examine the crisis of racial profiling, police brutality and lost trust between police departments,” according to the committee. The Senate Judiciary Committee has scheduled a similar hearing on “Police Use of Force and Community Relations” on June 16.
The images of Officer Derek Chauvin — who now faces charges including second-degree murder — kneeling into Floyd’s neck sparked a nationwide outcry and demands for reform. It has also led to similar protests and legislative moves across the globe.
House Democrats on Monday introduced a bill that would enact a number of reforms, including curbing qualified immunity, creating a “National Police Misconduct Registry” and making changes to police training. But it has fallen short of the demands by the “Defund the Police” movement touted by activists and some Democrats.
The hearing on Wednesday will also feature Floyd family attorney Ben Crump, NAACP Legal Defense Fund President Sherrilyn Ifill and Georgetown Law School Professor Paul Butler.

Republican witnesses include Pastor Darrell Scott — who sits on President Trump’s executive transition team and is a senior pastor for the New Spirit Revival Center — and former U.S. Secret Service agent and conservative radio host Dan Bongino, a Fox News contributor. They have also invited Angela Jacobs — the first black woman elected to Lancaster City Council and whose brother was shot and killed during recent protests and riots in Oakland, Calif.
The hearing comes a day after Floyd’s funeral in Houston, and on the same day as the funeral of retired St. Louis police Capt. David Dorn, 77, who was fatally shot June 2 while trying to protect a friend’s business from looters.
