]]>After the killing of George Floyd in Minnesota, advocates for police reform called to defund the police, ban chokeholds and more effectively punish officers who abuse their power or show racial bias. Before any of those proposed reforms can actually go into effect, lawmakers and department chiefs would first have to get past police unions.
Over the course of decades, police unions have fought to secure generous benefits for rank-and-file officers and helped make the dangerous job of police work more attractive to hundreds of thousands of officers. But when their members come under scrutiny for police brutality and heavy-handed tactics, it’s the union that often serves as their first line of defense.
The New York Police Benevolent Association and the Fraternal Order of Police did not respond to CNBC’s requests for comment.

]]>As calls grow to defund or dismantle police departments in the wake of the death of George Floyd, questions about what that would look like — especially in cities with high crime rates — remain.
In a Saturday interview on “Fox & Friends Weekend” with host Pete Hegseth, retired Dallas police officer C’mone Wingo said that imagining a city or town in America without law and order made the hairs on the back of her neck stand up.
“I just think that, in this case, they need to do a little bit more research,” she advised. “Not having police, defunding [and] dismantling a police department, and bringing in perhaps civilians to do the work…What are you going to do when the bad people come out? What are you going to do when the bad people show up? When you call 9-1-1 who is going to come out?”
“I think this is something they really need to look at and they really need to examine closely. Because even if I wasn’t a police officer, let me tell you I wouldn’t want to live in a city that doesn’t have laws,” she stated.
Fraternal Order of Police VP Joe Gamaldi pointed out that the percentage of the U.S. population that supports defunding or eradicating police departments is less than 30 percent. In a HuffPost/YouGov poll conducted June 8-10 just 27 percent of Americans favored the move.
That said, some Democratic leaders like Los Angele Mayor Eric Garcetti have committed to defunding their departments and the city council of Minneapolis has moved to replace police with a “holistic” public safety force.
“But, you know, the Minneapolis city council is too busy pandering to the mob to even notice that [statistic,]” Gamaldi remarked.
“And, it’s interesting, when they asked the city council member, ‘What does that look like when I’m being robbed. Who is going to come?’ And, they said, ‘Well, that’s just your privilege talking,'” he added. “Excuse me? That’s the privilege of every single American in this country to feel safe — to be able to call on police and have them come out.”

Gamaldi also noted that as the debate in Minneapolis’s “kangaroo court” rages, so does their crime.
On Wednesday, the U.S. Attorney for Minnesota, Erica MacDonald, met with Minneapolis Police Chief Medaria Arradondo and several federal law enforcement agencies to map out a plan to curb a recent spike in violent crime.
“This has gotten completely out of control,” Gamaldi asserted. “And, we don’t want to hear the pandering from the city council about ‘We are going to offer wrap-around services and holistic approaches.’ No, the community deserves answers. If someone sticks a gun in my face tomorrow, who is coming to help me? And they can’t answer that.”
Houston Fraternal Order of Police Pres. Dr. Oscar Odom told Hegseth that while a Utopian society is a nice concept, these issues “must be examined through the lens of reality.”
“I think that there should be a CompStat for political leaders to say, ‘This is your district area. How many murders have happened? And, how many robberies have happened? How many assaults have happened? And, what have you done?’ And, if you haven’t done anything, you need to be charged with negligence because you are not doing anything,” he said.
Odom maintained that while city leaders are “changing the game” on police officers “midstream,” it’s their constituents that are suffering.
“People getting robbed, murdered, crime rate — as stated earlier — is through the roof [with] over a 400 percent increase in crime. Who is going to pay for this? The citizens? Who is going to pay for this?” he asked. “And now, you see, some of the Democrats are trying to backtrack and say, ‘No, we don’t mean defund the police. No, no, we don’t mean take the money away.’ Because they see what’s happening.”

]]>Law enforcement officials are urging the Seattle Police Department to retake control of the East Precinct after hundreds of demonstrators overtook Monday the six-block area that surrounds it.
Officers effectively abandoned the area during violent clashes with demonstrators calling to defund the police.
Demonstrators have since set up occupancy in that section of downtown Seattle and have renamed it “Capitol Hill Autonomous Zone” (CHAZ).

“It can’t continue like that,” Jim Fuda, a law enforcement expert and the director of law enforcement services for Crime Stoppers – which works with SPD – told Komo news.
“Some action is going to have to be taken. Is there federal laws broken? Does the FBI need to come in? But at some point, arrests and these people are going to have to be removed, if they don’t move.”

Photos of the area show protesters have remained peaceful – pitching tents, painting, watching outdoor movies and holding gatherings with music and speeches – but police have also said they have received numerous complaints about armed guards surrounding the perimeter and asking residents who live in the area to show ID.
Police have also alluded to the potential extortion of local businesses and citizens.
Despite concessions by the city, including a 30-day ban by Mayor Jenny Durkan on officers deploying tear gas to disperse large crowds, as well as police officers shuttering the Third Precinct and retreating from the area, protesters have not shown signs of allowing police back in.

“Where are the rest of the citizens and their need for service?” Fuda said, pointing to the fact that police have limited their activity completely and are only responding to 911 calls.
The SPD is working on a strategy to negotiate with protesters but has been unable to identify the leaders of the group.
Michael Solan, president of the Seattle Police Officers Guild, told Fox News’ Laura Ingraham on Wednesday that the occupy-style demonstrations have gone too far and “is absolutely unreasonable activism.”

“We lost a precinct, now, what’s next? Are we going to lose another precinct? The city council has removed our ability to have less lethal ammunition for us to properly protect those facilities and protect ourselves,” Solan said.

“Contact tracing” has become the term du jour in the coronavirus era, as it’s largely seen as one of our best, time-tested tools to contain the spread of the virus and safely reopen the country. But it’s also controversial, especially with the rollout of digital contact tracing tools, some of which were created by data-greedy tech companies. Privacy advocates have feared that the public health crisis could give rise to surveillance methods that are applied to other areas long after the pandemic has passed. Some are stoking those fears.
The Minnesota Department of Public Safety raised alarm bells last weekend when Commissioner John Harrington said in a press conference that law enforcement was using “contact tracing” on arrested protesters.

“As we’ve begun making arrests, we have begun analyzing the data of who we have arrested and begun actually doing what we think is almost pretty similar to our Covid,” Harrington said. “It’s contact tracing.”
Not quite. According to Minnesota public health authorities, Harrington was referring to the normal process of law enforcement investigations. He did not mean that the police were using data from Covid-19 contact tracing efforts or tools to assist in those investigations, as some have interpreted his remarks to mean.
“He used the term ‘contract tracing’ as a metaphor,” Julie Bartkey, a spokesperson for the Minnesota Department of Health, told Recode. “Just as we at MDH have used the term ‘disease investigators’ to describe our epi[demiology] processes, they used a public health term. But their process does not involve public health authorities.”
A spokesperson for Harrington agreed.
“He is talking about typical criminal investigative work, not a new technology or strategy,” Bruce Gordon, director of communications for the Minnesota Department of Public Safety, told Recode. “He borrowed a term from the Covid-19 world.”
Contact tracing is the process of finding out who an infected person has had recent contact with, and then informing those people that they’ve been exposed to the illness in order to avoid further spread of the disease. In the absence of a national effort to contain the virus, states have hired thousands of people to do this work. Somewhat ironically, Minnesota does not appear to be one of them. The state has had trouble expanding its contact tracing efforts due to Republican concerns about the cost. Some states and countries have introduced digital contract tracing tools as well, though their effectiveness has yet to be proven.
But Harrington’s appropriation of a Covid-fighting term could make a public that’s already suspicious of law enforcement refuse to participate in public health efforts to find and help people exposed to the coronavirus, which would then render those efforts less effective. Considering that the mass congregations of protesters could become hotbeds for the spread of the virus, it’s especially concerning that the very people who would benefit most from contact tracing now have that much more reason not to trust it.
And they might not be wrong — at least, not entirely. Bartkey also said that the MDH doesn’t have a policy or law specifically forbidding law enforcement from accessing or using any information collected by coronavirus contact tracers or tools.
“Covid is too new to have legislation attached to it,” Bartkey said.
That’s a problem, and not just for Minnesota. The Electronic Frontier Foundation (EFF) has written extensively about the need for laws and controls over the data collected for the purposes of combating the coronavirus.
“We need new laws to guarantee such data minimization, not just for contact tracing, but for all Covid-19 responses that gather personal information,” Adam Schwartz, senior staff attorney for the EFF, recently wrote.
According to the Washington Post, a bill that would put limits on digital contact tracing tools and the data they collect will soon be introduced to the Senate. It has bipartisan support, including from Maria Cantwell, the highest-ranking Democrat in the Senate Commerce Committee. In mid-May, House and Senate Democrats introduced another bill that would similarly protect health data collected during a public health crisis. So that needed legislation may be coming, but it’s not here yet.

]]>Some Michigan law enforcement agencies say they won’t enforce Gov. Gretchen Whitmer‘s executive orders meant to combat the coronavirus pandemic. The orders have enraged the Republican-controlled legislature and led to armed protests as some residents grow impatient over statewide restriction measures and business closures.
In a letter Monday, Shiawassee County Sheriff Brian BeGole said his agency won’t actively enforce the mandates, the Detroit Free Press reported.
“I have decided, within my authority, that our office cannot and will not divert our primary resources and efforts towards enforcement of the Gov. Whitmer’s executive orders,” he said.
BeGole’s letter comes after a barber in Owosso, a city in Shiawassee County, reopened his business in defiance of an order closing nonessential businesses with armed militia members standing guard outside. His license has since been suspended by the state.

Four sheriffs officials in a northern part of the state — Leelanau County Sheriff Mike Borkovich, Benzie County Sheriff Ted Schendel, Manistee County Sheriff Ken Falk and Mason County Sheriff Kim Cole — said in April that the Democratic governor had overstepped her authority.
“We will deal with every case as an individual situation and apply common sense in assessing the apparent violation,” they said in a joint press release. “Each of us took an oath to uphold and defend the Michigan Constitution, as well as the US Constitution, and to ensure that your God given rights are not violated. We believe that we are the last line of defense in protecting your civil liberties.”
In Livingston County, Sheriff Mike Murphy said he will not enforce Whitmer’s stay-at-home order in response to a gym owner who reopened Monday and confusion over the legality of the order.
“Obviously he’s chosen to open. We’ve been working in concert with the [county] health department as well as the [county] prosecutor’s office since this thing started,” Murphy said told the Livingston Press & Argus. “The way things are right now, we basically decided to not do any enforcement. We’re asking people to voluntarily comply. But there are questions about the legality of the order right now.”
The Detroit Police Department has issued more than 730 citations over a two-week period in April, in addition to 1,000 warnings, the paper reported.

Most police departments are choosing to educate and get voluntary compliance rather than issue citations or making arrests, Bob Stevenson, executive director of the Michigan Association of Chiefs of Police and a former Livonia police chief, told the Detroit Free Press.
Lansing police are also handing out warnings and educating suspected violators about the mandates. If there are repeat offenders, a report will be made and sent to prosecutors for review.
Attorney General Dana Nessel last week issued a letter with guidance to law enforcement agencies that affirmed Whitmer’s mandates are enforceable and valid.
“The absence of these restrictions would open gateways for the virus to reach every family and social network in every part of the State,” Nessel wrote.
Whitmer’s office has been besieged by criticism, death threats and a series of demonstrations against her executive orders barring certain businesses from operating and rules dictating where residents can travel to. She extended her emergency declaration order weeks ago following a demonstration where protesters stormed the state Capitol building in Lansing.
